原来有套旧房子没买也没出租。去年底11月新房子交房,之前一直没有入住。一直到今年9月孩子上学才正式住进去。现在的问题是CRA不认可新房是我主居住地,说我信用卡,CRA账户,驾照地址都没更改。可是我孩子一直在我新房子地区入读,学校也开了证明。而且我们7月底开通了BELL网络,电视,电话,还有新开通的信用卡都用的新地址,因为我9月才入住,所以旧房子的信息都没有更改,现在CRA都无视事实,就非要认定我旧房子为主居住,把new house rebeat给拒了。我把旧房子网络也断了,她现在就说我10月17号之前给你发信,之后你所以改的都不算,可是我是11月初收的信,11月10号左右才第一次沟通。这样的事行政复议,还是直接找律师比较好,我事实确实9月才入住的。我孩子也是入读的我新房子所在区域的学校。

它们现在说7月底开的BELL不算。要9月入住你开通才算,而且要旧房子移过来,我旧房子除了网,电视,电话都是网络的。我在一起10月底断了旧房子的网。她说起10月17号以后你做的事都不算。问题就算我9月断网,它们10月也是开着的,,需要下个月才关闭。大家帮我分析下
 

Primary place of residence

One of the main conditions for a new housing rebate to be
available is that you must buy or build the house for use as
your or your relation’s primary place of residence.
Your primary place of residence is generally a house that
you own, jointly or otherwise, and that you intend to live
in on a permanent basis. You may have more than one
place of residence, but you are considered to have only
one
primary place of residence.

Note

If you buy or build a new house in Canada but your
primary place of residence remains outside Canada,
then your house in Canada would be a secondary place
of residence and would not qualify for the new housing
rebate.
The following are examples of some of the factors we may
consider to determine whether a house is your or your
relation’s, primary place of residence for purposes of the
new housing rebate:


whether you consider the house as your main residence;


the length of time you inhabit the premises; and


the designation of that address on personal and public

records.

To be eligible for the new housing rebate, your intent to
use the house as your or your relation’s, primary place
of residence must be evident at the outset of buying,
constructing, or substantially renovating the house.
For rebate purposes, a house is not your primary place of
residence if, for example, your intention is to use the house
as your primary place of residence upon some more distant
occasion, such as retirement. Further, a recreational cottage
or an investment property is not your primary place of
residence for rebate purposes. No new housing rebate is
available in these cases.

问题我新房子是主居的。。它无视而已。。。刚查的CRA网站看的它里面的例子,也没说要把新家搬空了,也没说一定要把驾照,信用卡给换了。

楼主情况比较麻烦,既不是主居,又不是rental,两边靠不着,都拿不到rebate。:shale:
 
HST New Home Rebate
There are many ways to obtain an HST rebate from the Canada Revenue Agency (CRA). An HST rebate is available under the GST/HST system to recover amounts paid in error or where the rebate is intended to provide specific relief to the taxpayer, such as the HST New Home Rebate.

HST New Home Rebate

The HST New Housing Rebate (or HST new home rebate) is available to an individual who buys a new home (or a substantially renovated house) from a builder or hires a builder to build a home for them on their existing property. For such purchasers, there are two components to the HST New Home Rebate: the federal and provincial portions of the rebate. For the 5% federal portion of the HST, the HST new home rebate is clawed-back for homes with a purchase price above $450,000.

Ontario, on the other hand, has its own HST new home rebate, called the HST New Housing Rebate that applies to the provincial portion of the HST (8% part) on new or substantially renovated homes used by the purchaser, or their relatives, as a primary place of residence. The HST new home rebate for homes purchased in Ontario is currently available up to $24,000 with no claw-back.

HST New Home Rebate for Rental Property

Similar to the HST New Home Rebate described above, there is also an HST rebate in Ontario for real property that is purchased for use as an investment property (i.e., rental property). In Ontario, the HST New Home Rebate for a rental property can be as much as $24,000.

Deadlines

There are strict deadlines to apply for the HST New Home Rebate. The general rule is that the purchaser must apply for the rebate within 2 years of their purchase or date of occupancy. What constitutes the occupancy date can be tricky and purchasers should be weary.

CRA Denying HST New Home Rebate

The CRA has been actively challenging HST new home rebate claims and disallowing the $24,000 rebate. Many individuals will have received a Notice of (Re)assessment that states their HST rebate claim has been denied and that they owe money to the CRA on account of not qualifying for the HST rebate. The CRA also charges interest on the outstanding amounts.
