Kanata-Carleton Conservative candidate Walter Pamic apologizes for removing illegal signs

Illegal for 3rd party sign to not say who it's from — and for most people to remove one

The Conservative candidate in Ottawa's Kanata-Carleton riding has apologized for taking down illegal election signs in his riding on Sunday, saying it should have been left to the city's bylaw department.

Kanata resident Keith Selevich said he was walking his dog Thor near the intersection of Teron Road and Beaverbrook Road around 5 p.m. Sunday when he saw someone who had been driving a white truck pull a yellow sign that read, "Have you thought of voting strategically? This is the time!" out of the ground and replace it with a Conservative sign.

When the driver got out again a short distance away, Selevich said he recognized the man as Walter Pamic, the Conservative candidate the new riding of Kanata-Carleton, which has no incumbent.

"I just took out the camera to record the license plate… I kept the phone on him and found out it was him," Selevich said.

Pamic said in a statement on Monday afternoon that he had come across "a number of illegal signs" along Teron Road and Beaverbrook Road.

"As [the signs] violated the Canadian Elections Act, I took it upon myself to remove them," he said.

"After discussing the matter with bylaw officers, I learned that I should have notified bylaw rather than remove the illegal signs myself. I apologize for this mistake."

Elections Canada rules say so-called "third party" election signs (that don't belong to a political party) have to say which group is behind them or someone could launch an complaint with its commissioner.

The yellow signs in question do not say which group created them.

Both the Kanata-Carleton Strategic Voting Committee and Vote Together national strategic voting campaign say the signs aren't theirs.

Elections Canada sign regulations also say it's illegal for anyone to remove an election sign, including a thir- party sign, unless it's a "public authority" such as the municipality or province doing it for public safety reasons.

Walter Pamic

Bylaw officers started to pull illegal election signs on Monday that recently surfaced in at least two ridings in an attempt to prevent Stephen Harper’s Conservatives from winning in ridings with tight races.

Sue Jones, the city’s acting deputy manager, said they received one phone call from a Kanata resident about the yellow signs bearing the words, “Have you thought of voting strategically? This is the time!”

“Now that I’m aware of these and concerned about non-compliance over the weekend, bylaw officers will be pulling these signs,” Jones said.

Jones said only registered political parties and registered candidates can put up signs on public property. It it against Ottawa’s bylaw regulating signs on city streets for third-party signs to be placed during an election.

The owner of the signs can get them back at a cost of $50 per sign, Jones said. There can be a fine of up to $5,000 but Jones said the fastest way to get compliance is to pull them.

Elections Canada said campaign signs must state that they are authorized by a third party. It is an offence to remove, cover up, alter of deface a candidate’s sign.

Kanata resident Keith Selevich said the yellow signs in Kanata did not say who authorized them, which violates the city’s bylaw and the Elections Act.

Selevich was walking his dog on Sunday near Beaverbrook and Teron roads when he saw a man loading the yellow signs into the back of his white truck.

Since Selevich wasn’t sure if the man was allowed to do that, he pulled out his phone to record him removing the signs and replacing at least one with a Conservative Walter Pamic sign.

Selevich said he realized the man in the truck was actually Pamic himself before he confronted the Kanata-Carleton candidate about removing the signs.

“They are illegal signs. They are not authorized by any third party,” the man told Selevich in an exchange caught on video. “All the other signs are authorized and these are not.”

Repeated attempts to reach Pamic on Monday were unsuccessful.

Even though the strategic voting signs are illegal, it is the responsibility of the city’s bylaw officers to take them down, Selevich argued.

Meanwhile, in the Orléans riding where Liberal candidate Andrew Leslie is leading in the race against Conservative incumbent Royal Galipeau, similar signs have surfaced.

Roger Clark, an activist with the Ottawa Action Network, said his group is behind the signs that read, “Vote strategically to defeat Harper.” He said he doesn’t know who erected the ones in Kanata.

Clark said he didn’t know the signs were illegal until someone pointed out to him last week that they might contravene the city’s bylaw.

“It’s certainly not that we set out to break the law,” Clark said. “I think there is an ambiguity in the legality there.”

Since Pamic launched his campaign on January 14th, Power-Tek has had three successful bids on government construction contracts: two from the Canadian Space Agency for $155,883.50 and $80,799.07, plus another from the Department of National Defence worth $168,000.

The DND contract was awarded on May 7 with a delivery date of September 14 – right in the middle of the federal election.

Pamic is running in Kanata-Carleton, a new riding carved out of two ridings previously held by Conservatives.

If elected, Pamic would need to declare his business interests to the Conflict of Interest and Ethics Commissioner (Power-Tek's contracts date back at least as far as 2010). Under the existing rules, he may be required to place his business in a blind trust due to its work for the federal government.

Those rules don't apply for candidates. Unlike in the U.S. where candidates for federal office must disclose their personal finances, Canada only requires disclosure after they're elected.

But what makes all of this awkward is Pamic's work with an anti-union lobby group actively promoting a new law that will force unions to publicly disclose their finances under the (potentially) unconstitutional Bill C-377.

Pamic is listed as the Chair of Merit Ontario; Merit Ontario is a provincial affiliate of Merit Canada, an organization representing non-unionized construction companies and lobbies for greater market access for their firms.

Merit Canada was named as one of the 10 most active groups lobbying the Prime Minister's Office in 2013.

Commenting on Bill C-377, Senator James Cowan said Merit Canada is “the true author of this unfortunate legislation.’’

In 2013, Pamic was invited by the Conservatives to testify at the Standing Committee on Transport, Infrastructure and Communities for a study on "how competition can make infrastructure dollars go further."

"I find it rather disgusting that my tax dollars go into projects that I cannot bid on for no other reason than my employees choose to be union-free," Pamic said.

Pamic forgot to tell the committee he's managed to make $2.8 million dollars off the federal government since 2010 anyway.
