小孩在加拿大出生，已拿到加拿大护照，但孩子父母均为国际学生，还是中国公民，如此情况，小孩十个月想送回中国，并想委托孩子的爷爷奶奶作为监护人，可以吗？ 都需要办理那些手续？

还有个问题好奇怪，大使馆不为小孩办理签证， 说是小孩未成年，而且孩子父母均为中国公民，因此小孩回国后将为中国公民对待，也就是说，小孩所持的加拿大护照是无效的，回国只须办理旅行证。 我的问题是，要向大使馆那么说的话，将来孩子还能回来吗？ 中国不承认她的加拿大身份， 她还怎么回来呢？

对不起, 你这个问题真的好奇怪, 所以, 请允许我用英语回答这个问题 ...

The most important thing is: Before you send your child back to China, make sure you have got the birth certificate for your child (to prove that your child was born in Canada). Make sure you get the "long form", which contains more information about your child. You can find out more from the provincial office. The web site is here (I assume your child was born in Ontario):

Later when your child reaches 19 years old (Canada's definition of adult), he/she will need to go to the Canadian Consulate Office in China to apply for immigration into Canada. In such case, your child should be able to get the PR status very easily because he(she) was born in Canada.

The point is: althought your child's nationality can be disputable, the fact that he/she was born in Canada is undeniable.

If you want to be 100% sure, you can find out from any lawyer who practice immigration laws in Canada. The money is well spent if you really care about whether your child can return to Canada to live. You'd better do that before you send your child back to China.

Sorry, I did not look at your question very carefully. I thought your child is still a newborn baby .......

Here is the information from Citizenship and Immigration Canada (CIC)which explain very clearly that your child will always be a Canadian citizen. Anyway, here is the link:

However, I believe your child can only be either a Canadian citizen or Chinese citizen, but not both.

我和孩子的父亲，均为中国公民，但我们不是借旅游签证，过来趁机生孩子的，我们持学生签证，已经连续三年没回国了，就是说我们并不是因为加籍而把孩子生在加拿大的，为什么给孩子签发的不是签证 也不是中国护照 而是个旅行证？！ 据说只有非法偷渡被遣送回国的人 才持有旅行证！
3。在国外出生的孩子，其国籍应该自主选择， 为什么要强迫给我们孩子中国国籍？！

I am not sure about point #1 and #2.

However, for point #3, since your child is not an adult yet, therefore he/she cannot legally choose what nationality he/she want. Chinese government in this case will only regard your child as a Chinese citizen based on the parent's nationality, also because most likely this child will be raised in China until he/she become an adult.

In some of your friends' cases in Toronto, they may only send their children back home for a short period of time, with the plan to bring their children back to Canada to raise, instead of sending them back to China until they become adults.

However, when your child become an adult, then he/she can freely choose which nationality he/she want to be. Chinese Government seems to recognize this point. Therefore the Chinese government only gives your child a travel document so that he/she can simply enter China legally.

The point about your child's situation is: When your child become an adult, he/she will always be able to return to Canada permanently if he/she want to, provided that the Chinese government allows your child to leave. And I can see that as long as your child do not get into trouble with the authorities, he/she should not have any problem leaving China.

你孩子是中国国籍,去大使馆办个中国护照,直接回国吧,将来孩子可以自己选择要哪国国籍.因为中国只承认一种,所以现阶段要了中国,加拿大国籍是不可在中国境内使用(不受加拿大领事馆保护的),将来孩子选择要加拿大国籍,中国国籍自动消失(不在拥有中国给的任何权利).

中国国籍法规定得挺清楚，第五条也没有什么矛盾。如果小孩合法地获得了外国国籍，就不再自动拥有中国国籍，还不够清楚吗？

看看这第五条 ----
第五条 父母双方或一方为中国公民，本人出生在外国，具有中国国籍；但父母一方为中国公民为并定居在外国，本人出生时即具有外国国籍的，不具有中国国籍。


如果父母双方为中国公民， 旅游加拿大2周，而生了孩子具有加籍的，[不定居]，马上带回国，。依这第五条[前部分]，是中国籍。但孩子有加籍，又不定居，依后部分？
好像又不符？
