If it's not on your property or it's a straddling tree, talk to a lawyer first.
If the tree is within the line of your property, it's yours. Otherwise, it's not.
Straddling tree grows on the line dividing your property and your neighbour's.
BTW, why cut the tree? If you can figure out a way to keep it without damaging your house, keep it! It's good for the value of your home when you resell it. Take it with a grain of salt. I'm not realtor nor tree export. I'm just a tree lover.
