LANGLEY (NEWS1130) - An $800 fine has been given to the woman convicted of killing six-year-old Joshua Bates in August 2007. RCMP feel a conviction of 'driving without due care and attention' is all the law will allow against Brenda Alice Reid.

Bates was killed when Reid's vehicle jumped the curb and accidentally crushed the child into the wall of a pharmacy at the Walnut Grove shopping mall. The judge considered a lot of factors when choosing a sentence, including Reid's safe driving record and the low level of "moral culpability" involved, and felt there was nothing more that could be handed down.

RCMP Constable Holly Marks agrees, and says while it may be cold comfort to the family, people at the scene did everything they could to help Joshua. The boy was pinned against the wall of the Walnut Grove Shopping Centre, after Reid hit the gas pedal instead of the brake pedal. "Really showed that there are really good spirited people out there and that the citizens of Langley care about the other people that are here, but it was a freak occurrence and, no things like this are not happening all the time around Langley."

Crown Counsel hopes Bates' death will be a reminder to pay attention to what you are doing when behind the wheel.

(CBC) A Langley, B.C., woman has been fined $800 in connection with an incident in which a six-year-old boy was crushed to death by her car.

Brenda Alice Reid was convicted of driving without due care and attention Tuesday for the August 2007 accident in which Joshua Bates was killed.

The boy was pinned between Reid's car and the wall of a pharmacy in Langley's Walnut Grove shopping mall after she mistakenly stepped on the gas pedal instead of the brake while parking her car.

He died in the ambulance en route to hospital.

Police determined at the time that speed and alcohol were not factors in the incident.
The fine imposed was to sanction the momentary lapse of attention by Reid and "is not a reflection or assessment of the precious life of Joshua Bates," Crown prosecutor Winston Sayson said outside the court after sentencing.

There was nothing the court could do that would in any way be proportionate to the loss experienced by the Bates family, Sayson said.

The judge said in sentencing that Reid's momentary negligence that led to the boy's death was out of character and not typical of "the otherwise careful and prudent manner in which the car was driven prior to the collision."

(CBC) Sayson said he hoped the case would remind all drivers to exercise great care when they get behind the wheels of their cars.

"A small mistake could take someone's life and cause much devastation," he said.

事故发生在2007年8月份,女子停车时错把油门当刹车,结果撞上男孩,男孩被卡在肇事车和一药房(位于Langley's Walnut Grove购物商场)墙的中间。后来,男孩在被送往医院的途中死亡。当时警方确定,超速和酒精并不是造成事故的原因。

在宣判中法官称,Reid的一时疏忽导致男孩死亡的结果并不符合她的性格,而且该案不属于事发前可预见结果的典型案例。

宣判后,检举人Winston Sayson在法庭外称,800元只是对Reid的瞬间失误给予了惩罚,但是并没有体现出小Joshua的珍贵生命,法庭无论做什么也不能弥补Joshua一家的损失。

Sayson称,希望该案可以提醒所有的司机在驾车时能够十二万分地小心,“一个小小的错误就可能会葬送一个人的性命。”

我夫人第一次考驾照时,本来已经过了,最后停车时却把油门当成了刹车踩,结果撞坏了考场的栅栏(没让赔),还把租的驾校老师的车给撞坏了(好在本来就是破车,又没买应该的保险,只要了我们$100)。

好在这错误只犯在考牌时。
 
错把油门当刹车可能性不大,倒是Toyota的车自己将油门当刹车的可能性更大一些。
