开车的朋友, 小心被恐吓敲诈


我一朋友 几年前发生一起撞车事件, 对方的车左拐撞到朋友正直行的车左后方(没人受伤).当时called 911,有警察报告, 明显对方的错. 保险公司认为错在对方，拒绝了赔偿对方的修车费用.
本以为事情这样就结束了。车祸后事隔两年多, 突然收到对方律师的电话索赔18万.让我朋友限期付款否则庭上见.....,我们认为事蹊跷, 拒付! 30天后真的收到了起诉书, 对方律师并电告声称有90%把握赢此官司, 到时候你们不光要付18万,还再加之法庭费, 律师费.....(恐吓), 幸好我朋友一直保存着当时撞车事件的完整资料. 第一次开庭前40分钟, 法庭告知对方延期了,下次安排在20天后. 等又过了16天, 又收到法庭信,告知对方看到朋友呈上的资料, 决定撤诉了!
近来得到消息, 对方的这家伙, 因另外的事件被抓, 我们才知道这家伙可称是职业"撞车手", 长久与律师勾结, 车祸是故意的(蹭一点, 没人受伤的). 所谓对方律师称的"证人" 也是其同伙, 专找老中下手, 恐吓敲诈(抓住老中胆小,语言障碍,....多次让他们敲诈得手).
此事告诫我们,
1)遇撞车, 一定不可move车位置,立刻要打911, 留下对方资料及警察报告;
2)遇到事千万不要怕; 据理力争;
3)有语言障碍的, 寻求帮助.
4) 一定保存好完整原件资料.

How about the damage is under $1000

As my understanding, the police will not show up if damage is under $1000. Car owners exchange their policy number and phone number, then deal with accident privately or call the insurance.

In that case, 留下警察报告 is impossible. You still have the risk of being 敲诈.

如果损失在一千以上或有人员受伤都必须报警，这是法律规定。一千一下的小事故也没什么好敲诈的，有争议的话到事故评审中心裁决。

since you purchased insurance, insurance company has the responsibility to cover everything. and that accident happened in the past, 2 years ago, you have no chance to lose. It's limited time responibility.
