Court overturns Ottawa’s decision to approve Globalive wireless launch

OTTAWA — The Harper government has suffered a blow to its efforts to actively shape the country's telecommunications sector, after a federal judge quashed the government's decision to overrule regulators and approve the launch of wireless services by Globalive.
In a decision released Friday, Federal Court Justice Roger Hughes ruled the government overstepped its bounds under Canada's telecom law when it overruled the Canadian Radio-television and Telecommunications Commission in the fall of 2009.
The judge also put in place a 45-day stay of judgment in order to avoid turmoil, meaning Globalive — which operates the wireless brand Wind Mobile — can continue operating for now.
