I asked a home inspector about fence post depth and related building codes and regulations. He said that fences are not covered in the Building Codes and he is not aware of any regulations. He suggested that I contact the City to see if there's any by-laws. But based on Cobalt's post, the City doesn't seem to regulate fence posts either.
Perhaps the 3-foot limit is simply an industry practice and not a code requirement.
I'm not a home inspector nor am I familiar with building codes, but I would suggest that you look into that more...
On the other hand, if there is a written agreement between you and EHS in that the depth of the holes need to be inspected by the home owners before EHS is allowed to pour concrete, then what they did yesterday violated a contractual obligation. But even that, negotiation should still precede agrument.
