Did VIP sign any paper with you? Perhaps VIP is only a coordinator to bring you to sign contracts with the supplier. He/She is not legally responsible, I guess.

Working with any group buy, you need know how they choose the supplier among suppliers, Do we agree with how he/she evaluate the suppliers? Most importantly, how much commission is he/she taking?

我们今年参加了VIP Group Buy的2017 Landscaping 团购。五月开始和 Ottawa Landscape Master 这家公司接触并与7月13号签约。现在发现这家公司完全就是无赖，我们7月中旬交了3万多定金， 到现在人既不出现，每次email也是好几天不回，拿了钱一个月了什么都没做。拿了定金以后他请的做泳池的sub-contractor来找我告状说他不付钱所以没法买材料。后来两家完全闹绷了， 泳池公司打电话告诉我说没法给我做了，让我小心这个公司不诚信。我问这家公司的头Ryan泳池到底怎么回事， 他撒谎说在市政府申请pool permit 有延迟，我打电话去问，市政府的给我回话说根本就没有和我家地址有关的任何申请。我一开始谈的时候告诉了Ryan我需要8月中之前至少完成deck和泳池，他同意了我才签的约。合同上说好最迟8/1 来给我做工程，三次了，每次都发个email说我们这个星期来，到最后都不出现。然后各种借口各种抵赖。我Google了一下这个公司， 口碑很差， 欠薪， 质量问题等各种负面消息一大堆。

8月2号开始和VIP group buy 沟通，回我email说会督促他们两个星期之内给我开工，并说如果无果到月底会帮助我拿回我的定金。8月4号应group buy 的要求把我们和Ryan Langtry之间的email截屏发给admin， 从此也没消息。我现在现在已经找了律师准备走法律程序取消合同。也联系了BBB和安省消费者保护协会。我本来以为VIP group buy 他们推荐的公司肯定是经过调查筛选的， 所以相信了“自己人”。 真心不愿意走到对簿公堂这一步，但定金不是小数， 都是每天辛苦挣回来的，所以在此也提醒大家一声不要再和这家公司签约。大家有兴趣可以Google一下Ottawa Landscape Masters 或者 Ryan Langtry, 你们会看见很多负面消息。

什么VIP团购？CFC上的不实信息，中国人喜欢贪图小便宜，结果吃亏了，当你人生一个教训吧。我家也做landscaping，我找谁来做？一看网上reviews，二看邻里街坊的工程效果，这是关键决定因素。西人公司的报价也能讨价还价，别信狗屁团购。我找的landscaping是渥村排名前10的landscaping，付款方式工程进行一半时支付50%，工程全部完工交付后再付余下50%。活做的效果高大上，我们非常满意，干活的都是白人小伙子，干活很卖力，用料足，工头就是老板的合伙人负责工程施工的是天天监督，每天收工时如果我们在场都会向我们汇报与交流，老板在铺石材之前还来double check，给大家借鉴。

既然钱都付了，应该没有什么比较好的选择了

首先那个公司如果要耍赖，那真没有什么好办法，该owner可以不理睬小额法庭的判决因为小额法庭并没有强制执行的功能，也可以再注册一家公司重新出发，大不了最后宣布公司破产

另外团购从理论上也有责任，不过到底多大就比较难说，关键是当初是否签了什么书面合同，像现在这样不回email就没办法的情况估计难办

当然LZ也可以被诈骗为由报警，不过现在恐怕还太早，警察可能会认为这属于合同纠纷，就算真的被认定是诈骗，3万是否能让警察动起来也难说

所以LZ要有心理准备，有可能花了律师费还是拿不回钱，如果能拿回一部分钱或者该公司最后来了不过工程质量较差....恐怕是最好的结果，不管怎么样都要看开一点，损失了钱再气坏了身体那就真不值得了

OTTAWA, ON - The Ontario Court of Justice has fined Ryan Langtry $15,000 for failing to comply with five orders to pay wages.



Ryan Langtry employed workers in the construction and landscaping industry in the Ottawa area. Langtry operated the business under his own name and the business names Ottawa Landscape Masters and RLCO.

The Ministry of Labour received claims from employees for unpaid wages. An Employment Standards Officer investigated the claims and found that the employees were owed a total of $5, 261.80 in wages and issued orders to pay wages.

The defendant pleaded guilty to failing to comply with five orders to pay wages. Before pleading guilty, the defendant paid the outstanding amounts of the orders in full.



The sentence was imposed by Justice of the Peace Linda Pearson in Ottawa court on September 8, 2016.



In 2013, Ryan Langtry was fined $17,000 by the Ontario Court of Justice for failing to comply with 13 orders to pay.

In addition to the fine, the court imposed a 25 percent victim fine surcharge as required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to assist victims of crime.

A person who contravenes Ontario's Employment Standards Act (ESA) or its regulations, or fails to comply with an order under the act, is guilty of an offence. An individual convicted under the ESA may be fined up to $50,000 or imprisonment for up to 12 months, or both. A corporation can be fined up to $100,000 for a first conviction, $250,000 for a second conviction, and $500,000 for a third or more convictions.
