Verdict expected Monday in sexual-assault trial of former University of Ottawa hockey players

THUNDER BAY — More than four years after they are alleged to have sexually assaulted a Lakehead University student at a hotel in this northwestern Ontario city, a pair of former University of Ottawa Gee-Gees hockey players are expected to face a judge’s verdict Monday.

Justice Chantal M. Brochu will tell Guillaume Donovan and David Foucher whether they have been found guilty.

The Gee-Gees hockey team was in Thunder Bay for Ontario University Athletics games against the Lakehead Thunderwolves on Jan. 31 and Feb. 1, 2014.

It was hours after that Feb. 1 game that the sexual assault is alleged to have occurred at the Victoria Inn Hotel and Convention Centre.

At trial, the woman, whose identity cannot be published, testified she met another member of the team, Taylor Collins, through an online dating app. After having consensual sex in his hotel room, she testified, she was sexually attacked and assaulted by the two accused. She vehemently denied consenting when asked by a defence attorney.

Charges were laid in August 2014. After subsequent delays, one each in 2016 and 2017, a French-language trial was conducted in February. Following two weeks of testimony by seven witnesses, including Donovan, Foucher and the alleged victim, the judge reserved decision.

The allegations led the University of Ottawa to announce the suspension of the men’s hockey program pending completion of an internal investigation. The university dismissed Gee-Gees head coach Réal Paiement, saying he had violated policies requiring immediate reporting of the incident to senior management.

Gee-Gees varsity men’s hockey returned to action in 2016-17 with a new head coach, Patrick Grandmaître, and only one returning player.

Twenty-two other players from the 2013-14 Gee-Gees roster — all except Foucher and Donovan — filed a class-action lawsuit claiming defamation through the university’s decision to suspend the program. The lawyer for those former players, Lawrence Greenspon, confirmed last week that the lawsuit is continuing.

TIMELINE

Jan. 31 and Feb. 1, 2014: The Ottawa Gee-Gees play the Lakehead Thunderwolves in a pair of Ontario University Athletics men’s hockey games at Fort William Gardens in Thunder Bay.

Feb. 1-2, 2014: In the hours after the Feb. 1 game, a 21-year-old female Lakehead University student ends up in the Victoria Inn hotel room of a Gee-Gees player. According to her subsequent testimony in court, she had consensual sex with that player, but then was sexually assaulted by two other Gee-Gees players.

Feb. 2, 2014: The Gee-Gees hockey team returns to Ottawa.

Feb. 7 and 14, 2014: Players Guillaume Donovan and David Foucher, who had both played in the Feb. 1 contest at Thunder Bay, do not play in Gee-Gees hockey games against the Concordia Stingers and Laurentian Voyageurs.

Feb. 19 and 21, 2014: Donovan and Foucher played in the Gee-Gees’ two OUA playoff games against the Queen’s Gaels.

Feb. 24, 2014: According to the University of Ottawa, its senior management is made aware of the allegations of sexual assault by Gee-Gees hockey players earlier in the month in Thunder Bay.

March 3, 2014: The University of Ottawa announces the suspension of its men’s hockey program. That suspension was subsequently extended through the 2014-15 and 2015-16 seasons.

June 25, 2014: Réal Paiement, head coach of the Gee-Gees men’s hockey team, is relieved of his duties by the university, which argues he did not properly and promptly inform senior management about the alleged incident in Thunder Bay in February.

Aug. 22, 2014: Thunder Bay police announce that Foucher and Donovan had been charged that week with sexual assault.

Feb. 5-16, 2018: After multiple delays, a trial conducted in French in Ontario Court of Justice in Thunder Bay. The judge, Chantal M. Brochu, reserves her decision until June.

Monday: Justice Brochu is expected to deliver her verdict.
