中国“海”字辈博士：江海松 vs 朱海洋

博士朱海洋毕业于上海海洋大学

2009年1月21日晚，在弗吉尼亚理工学院研究生生活中心一层餐厅内发生了一起残忍命案，来自中国并于2008年秋天到弗吉尼亚理工学院攻读农业和应用经济学博士学位的朱海洋当场将另一位叫杨欣的北京女孩杀死，新闻里说，当时朱海洋正在和杨欣一起喝咖啡，朱突然起身持刀行凶，将杨欣斩首当警方赶到现场是，看见朱海洋手里拎着杨欣的头颅，2009年12月21日，在美国当地的庭审中，朱海洋没有说明他杀人的动机，但检察官说，朱海洋在狱中写到，自己非常爱杨欣，是杨欣对他的拒绝，才导致惨剧发生。对朱海洋的起诉书中称，朱海洋曾向杨欣求爱，但是杨欣表示自己有男朋友并计划结婚，朱海洋为了实施谋杀先后购买了3把刀以及锤子等工具，稍后打电话给杨欣10多次，美国的法院将在2010年4月对朱海洋做出判决，最高可被判处终身监禁。

博士江海松毕业于上海交通大学

2010年1月3日，江海松送女友去机场, 违规闯入美国新泽西州纽瓦克国际机场安全区域, 并导致一航站楼关闭6小时。他将面临非法闯入安全区域的指控和最高500美元的罚款。

警方在查阅录像后发现，事发当时，江海松曾站在隔离带之内，安检人员走到他跟前要他站到隔离带外。不到一分钟后，安检人员离开了自己的岗位，消失在人群中，江海松的女友出现在安检口，江海松看到她后，从隔离带下钻过，和女友手挽手走进了已安检乘客区域。大约20分钟后，江海松走出机场安检口。

在美国最近全面提升安检的大环境里，那个机场联邦保安，已经制止过这个傻博士一次，傻博士也明白了也听从了，但是机场联邦保安随后离开30秒，这傻博士又钻了过去, 随后和女友消失在已经安检的人群中。

在中国，这叫公然顶风作案，挑衅公检法，屡教不改，民愤极大，影响极坏，后果极严重。

现在美国警方已经起诉他，对于女友也在美国的江先生，有了犯罪记录，将来申请绿卡和找工作，都是问题。

中国从来不缺不守规矩的傻瓜。

As I said the Chinese guy did a stupid thing for which he should be punished. In doing so, he has not violated any criminal code of the US, and his punishment will not land him with any criminal record.

If the US is a country by the rule of law, why treat him differently; Yes, I believe if this happen in China iunder the same circumstances, he will be sentenced to jail for N years

很简单的道理：

1. 警察不在现场，你就可以闯红灯了吗？或者说，警察不在现场，你闯红灯，就是警察的责任了吗？
2. 警察不在现场，你就可以杀人了吗？或者说，警察不在现场，你杀人，就是警察的责任了吗？

你肯定江博士没有 violated any criminal code？ 你如果不是学法律的，说这话有点不负责任了。因为现在警方 charge 他 Defiant Trespass。

Defiant trespass 属于刑事犯罪，有犯罪记录, Defiant trespasser 的定义是：

A person commits a petty disorderly persons offense if, knowing that he is not licensed or privileged to do so, he enters or remains in any place as to which notice against trespass is given by:
(1) Actual communication to the actor; or
(2) Posting in a manner prescribed by law or reasonably likely to come to the attention of intruders; or
(3) Fencing or other enclosure manifestly designed to exclude intruders.

Defiant trespass的关键是，当事人事先知道不应该进入。在江博士的案子里，录像和安全人员都证明，机场保安已经制止过江博士一次，所以江博士在最终钻过去之前，知道不应该进入。如果保安没有制止过江博士一次，证明江博士先知道不应该进入，还真的有点难度。

中国人多，如果经常有人在首都机场和上海机场，发扬你说的“中国精神”，乱闯安全区，那么首都机场和上海机场面临2个选择：

1 经常性关闭机场
2 实质性没有安检
