property line问题

我是个town house，正和邻居修fence。我们有一个property line问题：不清楚property line是基于foundation concrerete，还是墙上的siding。现在fence是基于concrete修的，如果property line是基于concrete，那大家都好。但如果property line应该基于siding，由于concrete和siding之间有>10cm的宽度，那意味着fence完全修到我的property内了。请见我的附图。

come on, just 10cm diff. does it really matter and bother you that much?
it will make a diff if ur neighbor start measuring from the edge of his roof? u will loose more...
in conclusion, measuring from the concrete wall. just my 2 cents.

Check the site plan. This plan should be given to you by your lawyer when you close your house.

Sorry, it's no a problem in 10cm or 1cm. I just want to do thing on a right and legal way. I don't want to involve any problem with my another neighour.

Yes, you are right. You should do it perfectly right now so you won't have any problem if you want to sell your house in future.

I think, for townhouse, you have only the using right but no property right (property right belongs to townhouse cooperation. However, if you are setting up a fense, it should be at the siding line. Otherwise, your siding is streching out to other's property.

Yes, I called the surveyor for my townhouse. It's CF0.01, which means "from corner of (concrete) foundation to right 1cm". So, it's based on the concrete.

It's good to know. And I think I will have no any problem for my two neighbours in the future according to this answer.

You need to check your survey, not plan. It is very clear if you have survey.
