Property line Questions

Run into problem with neighbour, Could anybody give me the right answer? Really appreciate!!

1.My next door neighbour built a garden that extented to my property without my permission 3 years ago. I didn't claim my rights at that time. She won't move the stuff from my side despite telling her recenlty, what can I do?

2.There is a tree on the property line, 3/4 on her side. She circled that tree with graden that particially in my side 3 years ago. It is the same that I didn't claim my rights at that time.She said it is her tree. Can she??????

3. Can a tree's branch that overhangs a property line be trimmed back by the party whose property it overhangs without mortally wound the tree. Does it required to ask permission?

you still have time to claim it because the city law says you have to claim it within 5 years or you lose your rights (but you have to check the city law yourself in case i got it wrong).
