LZ的照片和论坛周五(11.11)中午发,周六晚七点半被网管关闭了.


LZ一方的说法:

  • MINTO denied my friend's request to close the sale for the full price, but with a protest letter.

  • MINTO forfeited my friend's deposit ~$66,000, the reason, one document was delivered to MINTO one day late, so MINTO
    accused the home buyer defaulted on the purchase agreement

  • MINTO had that house sold for $5,000 more to another home buyer.

Minto一方的说法:


  • It was an inventory home, therefore, was already built with the reduce floor plan. The original buyer tried to back out after her PDI.

  • The new owner is my neighbor and they've purchased the house for the same original price.

  • Not willing to put all the blame on Minto, since her lawyer didn't produce the paperwork on time to back out, even after the buyer's lawyer screwed up, Minto offered her 2 alternatives that she refused.

  • According to the story, she had to turn some paperwork but didn't do it on time. Like GP said, she should be suying her lawyer because they are the ones in fault.


  • There is always another side of they story. It sounds like the lawyer is at fault. She should sue her lawyer and/or file a complaint to the law society. She should stop wasting her time protesting at Minto.


  • They offered her $10K off, that sounds pretty reasonable to me, yes the floor plan is smaller, but not significantly. They offered to build her the same house in a later phase, but this wasn't acceptable either. I'm sure this is why Minto is playing hardball and really who can blame them?

  • Anyone who can afford a $500K+ house, single, married, male, female, whatever, certainly isn't hurting. Cry me a river...

  • My guess is the offered compensation of 10K, which equates to roughly $100/sq ft, is what it would have cost Minto to build the slightly larger house vs what they did build. Her demand of 30K is more than a little ridiculous, not sure on what grounds she came to that price.

  • No one comes out looking good here. She should have lawyered up the moment she found out the house was built wrong.

  • I guess there are a lot of mis-information out there.I guess lawyers should be involved. And I don't know standing in front of Minto everyday will be any help.

ANY problems regarding the construction of your home should involve your builder, your lawyer and Tarion.

In this case they need to involve a lawyer to get everyones story and sort everything out.

This forum is no substitute for a lawyer. What you say here can (and has on many occassions) come back to haunt you in legal proceedings.
 
好像LZ几次在帖子里提到她买的不是inventory home。现在不知道原始买房合同里到底是怎么写的。
 
王管关掉这个贴子的原因可能是由于会招来律师方面的问题。发贴子的朋友用心是很好的,但对律师真得不能妄谈。签合同那天发生的事情除了当事人我们都无法知道,但如果律师只因为要去接孩子就把委托人抛开而致使文件无法完成,那当事人要起诉的首先就是律师,而不是minto。当事人已经损失的很多了,不能一损再损。

看了英文评论,又去查了原帖。
BDW原帖里说:
"一周后,我拿着Carlors Vicente给的YorkvilleC图纸,随Carlors Vicente去1023 Winterspring (Lot6),看正在建设中的房子。当时房子里面还是水泥、框架为主的一个个空壳,里面什么都没有..."

可见该房子地基及房型在BDW签字前就定下来,并开工了。不像是图纸房。:blink:
 
“Minto 对我们的要求一直不予答复,直到closing的前一天即5月25日,我的房屋过户律师来电邮告知:Minto给了两个选择(Offers):降价1万搬入“AS IS”的房子;或减免1万,但要按目前的市场价(list price)再买一个(1年内有效,过期没买的话定金不给了)。我们当天决定坚持原来要求,继续与Minto协商。”

从上面Minto给出的两个Offers, 看得出Minto还是认为他们自己有错。既然有错,对错误如何补偿就不能是犯错的一方说了算。Minto这样做完全是店大欺客。

你买了那么多房子,这个概念还不清楚?

我的理解是:看LOT、看图纸下合同,肯定不是inventory home;看房子下合同,肯定是inventory home。
 
很明显被Minto这狗屁公司欺负了。太毒了老外,比中国人手段毒辣多了。
 
BDW虽然可以从CFC上消失,但她的举牌照片已被多人存档。渥村是个不大的地方,低头不见抬头见的机会多了去了。

渥村真就是这么个龌龊的地方?有那么多龌龊的人?成天存档与你无关的人和事的照片和文字?

“看正在建设中的房子。当时房子里面还是水泥、框架为主的一个个空壳,里面什么都没有,随着Carlors Vicente的介绍来到厨房的位置时候,我觉得厨房相当小,我就问Carlors Vicente这个厨房是按图上的尺寸盖的吗?为什么厨房看上去都这么小?Carlors Vicente指着图纸说:“因为这个房子很大,所以厨房就看上去小,另外等厨房设备装好了,你就不会感觉小了。房子的尺寸怎么会和图纸不符呢? 这个房子就是按照这个图纸盖的。”

其本人的定义很清楚了,那是“看正在建设中的房子”。而且进一步的说明超过了你那“刚刚打地基的房子”的说法:“当时房子里面还是水泥、框架为主的一个个空壳”,但是已经能看出房间的布局。

我只从文字中判断那是个在建房,而且超过了“刚刚打地基”的阶段。其他事情,我难以下结论。

去买个二手房也可以拿着图纸看房。你没有看到卖房广告上常有floor plans?

楼主对和Carlors Vicente对话的中文翻译,真的那么可信?Carlors Vicente也许对和楼主的对话,有另一种引述。

从楼主的叙述来看,ccc说得对,楼主买房子的时候,那个房子已经开始建了。
