I have followed both sides of the argument with regards to the Omar settlement. At first, I thought it was crazy that we are paying this guy $10.5 million. However, as I read more into it, my opinions have changed. First, even if you disagree with the payout, even if the Canadian Government contested it to the Supreme Court, it would've lost anyway and the end result would cost taxpayers more. So in this respect, I don't think the Government had a choice to pay him out or not. Now on to the case of Omar himself. Omar was caught as a child soldier and Canada as a signatory of the 'Optional Protocol to the Convention on the Rights of the Child', we have obligations towards him which we didn't provide. The Supreme Court has already ruled that his constitutional rights were violated and his admission of guilt was done after being tortured at Guantanamo. At the end of the day, we can't be telling the world we represent freedom and rule of law and not talk the talk. You have to provide the same constitutional rights to everyone regardless if we agree with their opinions, actions or not. Otherwise, we sound like hypocrites. In the Omar case, Canada violated his constitutional rights and that is why we have the payout.
