you do have that right.
but under the law, the bartender is liable for you when you drink in the bar, so if you get into an accident or get into trouble, we are liable for your actions.

but with that said, not a lot of bartenders follow this, cause who's gonna turn away a paying customer?

i'm just stating the rules we're suppose to follow, even though most don't follow it, or not follow it strictly.
