朋友孩子租房一年,按规定提前两月通知 landlord 不续租了。可landlord 又从她银行账户里提走一月的钱。经交涉,landlord 承认错提了。并承诺马上退钱。快两月了,催问了N次了,就是不见钱。月底就要腾房子了。如果交了钥匙,landlord 找茬不退钱怎么办?

谁懂这方面法律条款?或有好主意?

没遇到过这样的情况,俺就是觉得应该这么办:
把租约留着 再把landlord从银行里提前的纪录留着
写封正式信警告landlord还钱。。。。。如果不还钱。。。。

不过应该找懂法律的人资讯一下
 
交钥匙前,一定把钱算清,房主欠钱,你不能交.他承认欠钱,要落实在文字上.

That is the problem that we thought of:
If we keep the keys after Aug. 31. They have the right excuse to reject returning the money.
If we return the key, they might find some other excuses, such as the wall damaged, the kitchen damaged, etc.
 
if there is damage caused by tenants, the tenant will have to pay, but not the entire rent of a month.
The last month rent is not for damage deposit, it is the last month's rent.
That is the problem what we thought:

跟老板发你工资直接存进你的银行账号是一个意思吧!你给他一张 VOID 的支票。他就能提了。

这个 landlord 很赖的。以前就干过同样的事。学生毕业走了。没法跟他斗。他就掖兜里了。

我上次搬家,LANDLORD因为60 DAYS NOTICE有争执,我当场打个电话给BOARD确定,然后马上搞定了。
ONTARIO 的法律是保护TENANT的,做地主不容易啊。

Regie du Logement du Quebec

The Régie du logement du Québec (the Quebec Rental Board) is a specialized body created by the Government of Quebec to oversee the laws and regulations that govern landlord-tenant relationships. It provides information on the rights and obligations under a lease and will resolve disputes between landlord and tenants informally or by way of formal procedures before a Tribunal. The Régie enforces regulations on such things as legal rent increases, noise and vermin, payment of rent and eviction, and procedures on how to approach your landlord to make necessary repairs.

Information about lease laws, FAQs, Sublet and Lease assignment forms and the locations of the 6 Montreal area offices are available in French and English on the Régie du Logement du Québec website, or call 514-873-2245 to obtain more information.

To file for a hearing at the rental board you must go to the Rental Board with a copy of the registered letter you sent to your landlord. There, they will guide you through the procedure of opening a file, but it will cost you about $65 (which your landlord will have to pay you back if you win your case). Keep in mind that it can take up to 8 months before you get a hearing (the wait will depend on the urgency of the situation). When you show up at your hearing, make sure to bring all relevant documents and proof (pictures, letters, witnesses).

The Rental Board also has a black list of landlords and tenants, which you can see, upon request, if you visit their office during their open hours.

Problems which concern the living conditions of the dwelling are best settled between the landlord and the tenant. Try to negotiate a settlement directly with the landlord. Remember that when negotiating with the landlord all communication should be in writing. Keep a copy of everything that you send him or her, and send it by registered mail. If the landlord is unwilling or unable to act, you can request that the Régie du Logement render a decision for you.

很有用。虽然可能会耗时。但真打上官司还是能赢的。
