The screens on GPS devices may be viewed while driving, provided the device is mounted on the dashboard or secured to another place in the vehicle (for example, on a GPS windshield suction mount not blocking the driver's view, or in a GPS dashboard mount).

well, my point of view is area of driver's viewing is roughy where the coverage of driver's side of wiper.

The reason is when doing Ontario Safety Certificate, one of the failing reasons for windshield is crack/obstructive on driver's view which roughy by dricer's side wiper's coverage.

My 2 cents.

I think it is illegal

Please read the attached link:

Usually, policeman won't bother to stop you, that doesn't mean this is legal (vs using cell phone!!)

The same if your license plate is blocked....

I think, as long as you are not stopped by police because of speeding, rolling stop, dangerous driving, running red`yellow light, then most of the time, you are safe. if you are stopped because of other offense, they can add another to your ticket.

Highway Traffic Act Section 73(1)

The provincial Highway Traffic Act prohibits having any object obstructing the driver's view through the windshield or windows.Section 73(1) HTA states that "no person shall drive a motor vehicle upon a highway, with any sign, poster or other non-transparent material or object placed on the windshield or on any window of such motor vehicle; or with any object placed in, hung on or attached to the motor vehicle, in a manner that will obstruct the driver's view of the highway or any intersecting highway."

Since I am NOT paralegal, I hope any CFC member who happens to be paralegal and is knowledgeable to explain this HTA to us.

To me, it is subject to policeman (and finally JUDGE) whether that GPS actually obstructing the driver's view. Remember, if policeman says YES, then policeman gives you a ticket, (like policeman said you were ROLLING STOP), then you have to defend yourself. Then, you have to convince the judge to agree with you instead of police.

In the article I quoted above, there was spokesperson from Ontario Ministry of Transport who added something, (to me) that means he agreed on the article title "GPS units blocking car windshield illegal, law says".

Hence to avoid being ticketed for this, I follow the advice "To avoid possibly running afoul of the law, it might be best to mount your GPS unit to the front of the dash (not on top) below the level of the windshield."

Charges under S. 73(1) HTA carry a $110 penalty. And, yes, before you write in, I'm aware that police themselves often have equipment (radar, large strobes etc.) mounted on their cruiser dashboard that blocks the driver's clear view of the road ahead. No exemption for police under this section of the HTA could be located.

Have you ever heard of policeman ticketing another policeman???
If you are policeman (working in the same city), just show your badge....
Unfortunately, this is the reality we have to live with as Canadian citizens.

Yes, I would do that.
