"Banke’s lawyer, Joe Addelman, argued his client shouldn’t be held responsible for the actions of others and asked for a nine-month sentence in jail instead. Banke wasn’t drinking, only accelerated for about three seconds and didn’t try to flee the scene, he pointed out.
Banke, an apprentice mechanic and member of the Motorsport Club of Ottawa, was driving a modified version of his car designed to increase power and performance. It had the steering wheel on the right-hand side and a six-cylinder engine to go along with numerous other changes made that weren’t standard.
The tires, despite previously passing a safety check, were worn and within 1/32 depth tread of failing."
