法理上：
- 1895年《马关条约》：清朝在甲午战争中落败，被迫与日本签定《马关条约》，第二款第2条注明将“台湾全岛及所有附属各岛屿”割让与日本，但日本主张钓鱼岛不包含在该条约的台湾附属岛屿之中[11]。 但中方（大陆和台湾）主张钓鱼岛属于台湾附属岛屿之中。 【所以有争议】
- 1943年《开罗宣言》：《开罗宣言》承诺将“台湾、澎湖列岛等”在《马关条约》中割让的土地归还中国（当时为中华民国政府所代表）[28][29]。
- 1945年《波茨坦公告》：日本无条件投降时于《波茨坦公告》中接受《开罗宣言》，其（第八条）明确规定日本主权限于本州、北海道、九州、四国及美中英三国所决定的其他小岛之内，而条约当中没有提及钓鱼岛群岛。【钓鱼岛在哪？】
