You just don't get it, do you? The point is: it's not up to you or me to decide. The judge made a decision, that's the end of it.

过客 said it all, "right to court" is one of the fundamental rights that everyone in this country has.

Now just a side note: I believe that getting a ticket is already a good lesson to most people. It worked for me.

但本例不同，放他一马，就会直接损害被撞人的利益。被撞人的车谁修？只要他不是100%的责任，被撞人的保险就会涨，那被撞人会甘休吗？这种事本该私了。先出点倒酶钱，别让警察参和。这没眼力见的还恨不得告警察不公。
当然，这楼主如果闲在家里没事可做，去看看热闹，练练胆子也无妨。

事情的经过是这样：我们在小区里逛完yard sale,打灯发动汽车出来、就与另一车的车头相撞，我们都是同一方向，一个是左边车头变形，一个是右边车头变形，对方是白人，警察来了只给我一张罚单，罚款理由是：start from stopprd or parked position not in safety.但是实际上对方也有责任，她一边吃苹果，一边开车，并且她承认停在我们后面的车挡了我的车，还有就是她的车速太高，我质问警察，警察无话回答，警察只强调她的路权。现在的问题是想请教前辈，对这张告票，我们应该选择上庭还是选择仲裁?着急！大家有什么好建议说说看，先谢了！

你应该负责任，而且警察也不是因为她是白人，而你 是中国人就给你罚单的，因为这很明显是你的错。她说你后面有车挡了她的视线应该是在向警察描述事情经过，实际上她那样说是对自己有利，并不是要向谁"承认"什么。吃苹果就不用说了，如果她超速太多的话，那就应该是她和警察之间的事了，和你没多大关系。下次注意吧，这种驾驶常识G1 ROAD TEST就考过了。

所以说, 你的例子如果是真实的, 他必然有正当的理由, 比如有病史之类的. 如果简单的这样说, 相信法官不会相信他?

比如, 你超速, 你能不能说生病要去医院, 你觉得法官会信你吗? 这种借口多得很, 没有其他的证据, 仅仅编个借口,法官不会信的.

不要懂点就说 "play by the rules", 立法和制定规则的精神是让人去遵守的, 不是让人去 play, 更不是让人去钻空子.

正确对待法律和规则的态度是尊重他们. 如果你受到不当或不公对待, 必须需要的时候才使用. 当你自己明明知道错的时候, 象楼主, 凭他讲的事实, 他的确是 "start from parking position not in safety", 还有 accident 为证. 为什么还要去上庭? 你不也知道法官不是白痴吗???

Isn't it already obvious enough that there is no need go to court?

Or, what "fact" are you going to tell the judge? Please be specific.

还没看出来这个CASE有歧视存在的成分.不要动不动就说人家怎么歧视.自己也要多检讨检讨.

Fighting in the court is the legal rights of any individual including a murderer. Also, taking advantage of the loophole in the legal system is acceptable by the law.

However, taking advantage of the loophole in the legal system, when the accused is clearly at fault such as the present case, may be held to be inmoral by others.

Such arguements will hardly reach any results.

I used to get a parking ticket and I went to court. Finally my fine was dropped to $5 after I pleaded to guilty. The point is it will enhanced your understanding about laws of driving if you could go to court. That''s why most fines are dropped or waived if you go, even though it's your fault.

It doesn't mean you are not guilty unless Police is wrong. Personally I encourage you go to the court and describle what happened in accident to Judge honestly. I believe the fine will be deductable even you plead to guity.
