[请求] 在停车场被一辆倒车的车刮了前保险杠，该怎么办？

我当时正要进入一个车位，但位置不太正，我把车停下来，想摆正了再进。可旁边的那车突然起动并往后倒，我连续按喇叭提醒，可那车还是直倒上来，碰了我的前保险杠和车牌。那辆车的侧后保险杠及旁边也有划伤，比我的车划伤严重。那车的驾驶员是一个西人中年妇女，我要了她的姓名地址电话和保险号码什么的，她也要了我的information。当时还想找个证人，另有一个西人妇女在旁边看了一会，我正要找她作证人，她就溜了。

我认为不是我的过失，就叫了警察，可警察来了说这是一千刀以下的小事故，他们不给出报告，让我们自行跟保险公司联系解决。还说这是no fault的小事故，保险公司应该赔偿对方的损失。我说我只是想有人能证明我没有过失，可警察又说都有过失。我就是不明白，明明是她的车撞到我的车，我当时是停下来的，又按了喇叭，怎么我也有过失了。警察走后，那中年妇女说我应该倒车给她让路，她说她看了后视镜，没看到有车，也没听到我按喇叭。我的车上只有我的家人，没法当证人。她又说如果修车不超过500刀的deductable，就不报保险公司，自己各付修车的钱，如果超过，就报告保险公司。按她的说法，我的车被碰了，我的保险公司还得付多的钱来维修她的车（因为她的车损伤较严重），然后我的保险还要受影响？这可太不公平了。

因为第一次遇到这种事，我也不知该怎么办。我的车损伤不大，可修可不修。我也不希望涉及保险公司，怕影响以后的保险费。后来就归还了那西人妇女她的保险号码，我也要回了我的保险号码，双方只留了姓名地址电话。她说如果维修费超出500，她还是要报保险公司。那我的车肯定不用花超过500刀，我应该怎么办呢？如果我不报保险公司，可她报了，岂不是恶人先告状？如果我报告保险公司，又怎么能证明我没有过失呢？

你真嫩的可以.

1.在停车场, 你的车不动, 她的车动, 当然是你有理,因为你没有过失,警察算个屁,既然他又不出报告, 当然可以随便糊弄.

2.你放弃了对方的保险号,简直莫名其妙嘛.对方不作恶人不行了.

3.如果你对对方的话言听计从, 那干脆认定对方是个好人, 一条胡同走到底吧.

你说对了一半，但警察的报告只是保险公司区分责任的一种方法，例如，证人也是保险公司区分责任的一种方法。

如果你的车在家门口被人踢了一脚，并踢坏了，也不是交通事故，警察根本不会出报告，但是如果有证人证明你的车被人踢了一脚，即使没抓住那家伙，保险公司也会赔，而且不是你的责任。

Assuming that your statement is objective, if you think it's worth you might want to prove who is innocent. Some parking lot has surveillance cameras which might capture the event if it's not too long ago.

I have had similar experience before. I understand your feeling. However, I did not even have the licence plate number of the car that hit me (wasn't fatal, just a bump on the side) as it was on a highway on a stormy winter evening and the car fled. I wish I could find out the driver in order to give him a lesson and hopefully less possibility for him/her to get into another accident. I suggest you try your best to prove that lady caused the problem so that she will be more careful driving in the future, otherwise there could be more problems because of her careless driving.

Also try to be more protective when handling a car. There are some terrible drivers out there. Always know your surroundings and get ready if anything happens.

Call her to tell her that you have witeness (the person who was sitting in your car wasn't your family member but your friend), if she doesn't pay you $200 to solve it privately, you will go ahead to change a brand-new bumper (cost more money) and make a claim, because it was her fault, your insurance company will pay for your new bumper first, then ask money from her insurance company. Her insurance company will pay your insurance company first, then raise her insurance.

I had similar accident early this year, the guy was very nice. His insurance company suggested him to solve it with me privately (if I make a claim and change a new bumper, eventually his insurance will go up). He offerred to pay me maximum $300(the amount he could afford), because my car was new and the problem was minor, I accepted $200.

If she makes a claim and gets her car repaired, it doesn't affect your insurance because 1. she doesn't have your policy number. 2. She doesn't have witeness. 3. If she lies that you hit her, take her to court.

首先对方不会恶人先告状，告了并不是她说是什么情况就是什么情况。保险公司会调查，根据车的损坏情况进行判断。

如果你不想各修各的，确认是对方全责，就打电话给对方，告诉她要么私了陪你钱，要么你就到small claim法庭告她，法庭上不管谁坐在车里都可以作证。当然不能作伪证，否则查出来不得了。

your family members will not be considered witness because of their conflict of interest. It looks like that you will have to take care of your car (repair) and the other person will do so from her end. If you bought comprehensive, and you have a low deductible, you will be able to claim some money back from your insurance company. Since you do not have the other person's policy, it is very hard to find her insurance company to pay for the (repair cost- deductible). you simply had a purely bad luck in the parking lot that day.

my experience

It was a hit and run case happend to me this summer. My car was in the parking lot. Some one hit my car and run away without notice. i reported to the security and police. The police said because the damege was less than $1000, I wouldn't need a case number to claim, but he set up a file and mailed me a case number anyway.

small claim用于个人或与组织间的小经济纠纷（好像是低于7000)的法庭。其实就是你认为对方签了你的钱(包括你这种情况），他不给你就找法官评理，赢了它就必须赔你。
上庭不用律师（太贵），不过你可以找免费律师咨询一下。

In Ontario, the no-fault insurance policy means my insurance company will pay for my car damage no matter it is my fault or not. The following is quoted from http://www.execulink.com/~impact/insurance.htm

In fact, it is not a matter whether we know which insurance company pay for the damage.

If you are at fault, the insurance premium will be increased next year. Otherwise, the insurance premuim will not be affected by this not-at-fault accident next year.
