I believe that by law in Canada, once a couple is separated for more than 1 year, the divorce becomes in effect, you can then go ahead and file for the divorce even if the other party does not agree.

如果当初没有分居协议，就需要有分居的确凿证据，只要1年就可以单方面申请离婚。如果没协议没证据分居10年也不算。
