紧急求助

今天下午被人追尾，

跑到警察局，倒说成是我的错了， 还要罚款。

对方英语好，先说是我连变2条线； 处理的警官没有让我陈述， 就画个图， 问我是不是这样变线。 我说不是这样变线。

但MADAM还是判我错误。

我想去COURT告他（按照罚款单上的说明）， 因为我老公当时也在车上，属于目击证人。 对方就一个人。

不知道哪位有类似经验。

还有， 我是否要去修我的后保险杠， 因为有个坑，（一年新的车）
现在去修， 按照警察局的判定， 保险公司认为我是全责， 那不麻烦？
当等到打完官司再修， 岂不耽误了修的窗口？

哪位做汽车保险的朋友， 能否给解释下。

I had a ticket to go to court due to turning to the left during yellow /red light last month. The police wrote me $180 ticket. In the court I answered very firmly not to guilty. After the police and me describe the scene in each other, I lost the case completely. I was quite angry paying the fine right away even though there was 3 months period to pay. Just to forget all these about.
Here’s some of my thought,
1. If you decide to go to the court, bring your husband with you as a witness. When I received the ticket, my husband was with me. I asked if I could bring him with me in CFC. Someone mentioned that might be an interest of a conflict..... So I didn't. But one of the court officer said that would help me if I did.
2. Please guilty with explanation is much easier to reduce the fine/record than answer not guilty. There were about 10 cases in that day. All people (some with lawyers, witnesses) except me pleased guilty but with explanation. They all get less guilty or pay less. In my case, both the police and I hadn't have any evident, I felt the court rather believed the police. In the meaning time I wouldn't eliminate the factor of my English. Let's turn around, if I pleased guilty at that time, I could say I was late to pick up my kid in daycare, bla bla ….. Probably I would pay less than in the ticket.
Anyway when I decide to go to the court, I thought about the worst result that no more than pay the fine in the ticket, but I could gain some experience facing court. Sometimes we have no choice to face an unpleasant thing in anywhere.

可能法官不会接受"老公"作为"目击证人",因为他是利益相关人员.

如果打算上庭, 认真将事故发生经过写在纸上,确保论述没有自相矛盾, 让法官觉得你很有说服力. 如果感到英语表达无法稳超胜劵,听说可以向法官要求翻译官.

追尾不一定都是后面车全责, 虽然大部分情况是后面车全责.
如果后面车100%正面撞上前面车100%的尾, 后面车全责>99%.
如果后面车部分撞上前面车(比如说, 右前撞左后,左前撞右后),情况就不一样了.

几年前,下雪天,一位朋友新车被撞,对方想跟他私了,他不肯, 打电话叫警察,结果警察来了,经过分析, 警察认定对方车没有错, 是我朋友的错. 我朋友很后悔,认为撞车总是撞车人的错, 看到对方也心虚, 而事实上, 警察听完事故经过后, 列举交通规则, 发现是被撞车司机(我朋友) 违反交通规则,撞他车的司机反倒没有错. 最后结果是,我朋友新车被撞, 被扣点, 被罚款, 车保险涨1倍. 对方是大车,没什么损伤,放弃任何索赔.


几年前,下雨天,另外一位朋友换线后已将车身100%变直,后面的车发现车速太快,如果撞上我朋友的车,肯定是后面车100%的正面撞上前面车100%的尾, 后面车全责.结果后面车紧急打方向盘撞向路边. 虽然2车碰撞没有发生, 我那位朋友也心有余悸.他认为他当时如果观察仔细一些,他就不会换道,而导致后面车撞向路边.

以前同一位老前辈聊天,他说他开车25年无事故.旁边的朋友问他,有时是别人撞上你的车. 他说,开车的最高境界是不被别人车撞, 不撞别人车比较好避免, 不被别人撞的主动权不在自己手上. 他说,他年轻的时候, 刚开车不到3个月,就被追尾.虽然不是他的责任, 但是,让他深刻体会到"不撞别人车,并不能保证不被别人车撞". 从此以后,他随时观察周围的车流,永远保持一定的车距,随时提防周围的车可能的违章行为. 他说,即使是别人车的错,如果能够避免,还是要避免.
