The closing day of our house is June 30th, at 12:00am we submitted the cheque and signed paper, and lawyer said we can get key in 3:00pm, but by 3:00pm, we didn't received the key. We called the lawyer's number, it's just rescoring. From yesterday 4:00pm to now July 1st 10:00am, we didn't get any message from the lawyer, even a call.

So do you know what's the responsibility of the lawyer for this happening?

is it written in your contract? if yes, then the one who supposes to give you the key should take responsibility or you might can call the owner and see what happened. They must try to trick you by setting the move-in time at 3:00p.m. on Friday because everyone almost was off from his work at that time. So you can do nothing if something happened. your lawyer is not a good one.you have to be prepared to struggle for a battle if you want.

did you leave a message yesterday at 3:00 on your lawyer"s phone? you have to get some proof that you did not receive the key and you already let your lawyer know. send a fax to your lawyer to make sure you already notify your lawyer about this matter. he might blame on you that you did not let him know at the first place. i hope you left a message on his phone yesterday.

Hey. You were supposed to get the key on closing day because legally you would be the new owner of the house on that day. I had the similar issue. My home was close on June 27th, I signed the paperwork one day before and gave my lawyer the cheque. He told me that I would get the keys around 1:00pm on closing day, but I received the keys at 4:30pm. Since everthing was ready for moving on that day, if I hadn't gotten the keys, everything would be messed up. What I did was just keeping calling my lawyer again and again, and let them know that I was waiting for the keys. You shouldn't trust the answering machine, should try to get in touch with the real person and push him/her. That is the only way to deal with this kind of things, I think.

I believe it's your lawyer's responsibility to help you get the keys. If he/she didn't do that, that's his/her fault.

It's reasonable not got the key on June 30, but you should get it today (July 2), that's all because of the fault of mail delivery, considering July 1st was Canada Day.Normally, your cheque and the key would be delivered one by one by express delivery providers, as you described, obviously, you did not leave enough time for them to finish the two deliveries on June 30. Note: The seller's lawyer(not agent) would not mail the key to the buyer's until s/he had received the payment for the poverty.
