交通事故上法庭，警察未来，保险公司会赔偿我吗？

数月前发生一起交通事故，本人车辆损毁，当时警察判我闯红灯，开了罚单，扣3点。保险公司也不作任何赔偿，并已经涨了我的保费。近日上法庭作无过错辩护，结果当事警察未来，法官宣布案子dismiss。这样的话，我的罚单和扣点都取消了。但是保险公司会反过来赔偿我吗？请有经验的朋友解答。先谢了。

你的车为什么撞毁了?是撞柱子上还是别的车.
如果你没有买full cover的保险由于自己的责任撞毁保险公司是不会赔你的.

我现在的问题是，在法庭开庭，当事警察缺席的情况下，我应该是胜诉方，理应在交通事故中判我无责任，那就是对方的责任。在我无责的情况下，我的车损毁了，我的保险公司是否应该赔？如何与保险公司理论？谢各位指点。

你的案子dismiss了，可是对方也没有被判是责任方啊。

现在，你的案子dismiss了，如果你为你的车买的是全保，保险公司应该理赔。但是，你的保险费不会不涨。

My understanding is that there are two things in this case: 1) Accidental fault/liabilities; 2) Legal charges pressed. The court dismissed the 2), but which does not necessarily mean that you are fault free in the accident 1).

So, to re-negotiate with insurance company, you may still have some work to do...

谢谢楼上二位的解释，现在弄懂了，可惜我的车不是买的全保。看来出事故时现场处理最重要。对方是当地人，熟门熟路，搞定警察，接下来再上法庭也没用了，顶多免掉罚单，教训。不过接受楼上的建议，再找保险公司协商吧。

I do think so.
I think it is the decision of insurance company to determine whether it is your fault or not, even LZ case was dismissed in court.
The other party insurance company will base on police report (if any), and the situation, negotiate with LZ insurance company to determine percentage fault between the two parties.
Court dismissed the charges only means there is no record or demerit points.
If the charge stays, then it is easy of insurance company to decide who is responsible for the fault.

Did you really running red light?
The police didn't say you ran yellow light but red light.... (both carry 3 demerit points, and red light is even worse, and more dangerous!)
Personal safety (and other drivers safety) and health are more than more important then M....
