Calypso vows a vigorous defence

Calypso will “vigorously” defend itself, according to a statement released Wednesday, against allegations raised in recent lawsuits brought against the Limoges water park.

One lawsuit filed June 30 alleges Katherine Noah, 20, suffered an injury on the “Orange Bobsleigh” ride in July 2012. It seeks $1.75 million in damages for back pain and headaches caused by the alleged incident.

Calypso responded by saying the slip and fall occurred at the end of a ride and resulted in a “scrape to the person’s back.” The statement said this action “claims grossly excessive damages.”

Another lawsuit filed May 28 alleges North Kawartha’s Katherine Stokes suffered injuries from an incident at the wave pool in July 2010. It seeks $250,000 in damages.

In its statement, Calypso said the alleged incident happened longer ago than the two years permitted within the statute of limitations and that, “during its four years of operation, children and adults have enjoyed the wave pool in safety.”

A third claim had been reported involving a confrontation between two groups of patrons on the Calypso grounds, said the statement. The lawsuit alleges Calypso employees were involved but the statement said “neither Calypso’s infrastructure, nor its employees were involved in this fight.”

Police were called and intervened, and one of the individuals faces criminal charges, the statement said.

Still other allegations that Calypso over-serves alcohol are unfounded, according to the statement, which said employees who serve alcohol have Smart Serve certification and are “trained and familiar with the rules and regulations.”

Calypso is scheduled for court in September on 20 safety-related charges laid by Ontario’s Technical Standards and Safety Authority, unrelated to the two suits.
