HIV-positive man charged again with failing to disclose status

Police have once again charged a gay activist and HIV-positive man, alleging he failed to disclose his status to a young sexual partner.

Elliott Youden, 33, was acquitted of sexual assault in June after police charged him in connection with a July 2010 incident in which a Carleton University student alleged that Youden kept his HIV status a secret before the two engaged in what the young man said was consensual sex at Youden’s apartment.

In acquitting Youden, Ontario Superior Court Justice Monique Metivier said she couldn’t rely on the evidence of either the accused or the student and that the Crown had failed to convince her beyond a reasonable doubt that Youden was guilty.

In the latest case, police were called to Youden’s apartment on St. Patrick Street on Sunday night just after 9:30 p.m. by a 16-year-old boy. Police allege the teen was sexually assaulted and extorted for an undisclosed sum of money.

Police believe there could be other alleged victims and are encouraging anyone with information to come forward.

Youden was scheduled to appear in court for a bail hearing on Wednesday. He is charged with aggravated sexual assault and extortion.
