SIU head urges Bordeleau not to discuss officer assault case further

Ontario’s civilian police watchdog will not try a criminal assault case against two Ottawa police officers in the media, the head of the Special Investigations Unit said one day after Chief Charles Bordeleau said he was waiting on an explanation for the charges.

In an email to the Citizen, SIU director Tony Loparco confirmed that he and Bordeleau had spoken about the assault charges laid by the civilian oversight body Monday.

“As Chief Bordeleau knows, this matter is now before the courts,” Loparco wrote. “We are not going to participate in the trying of this case in the media.”

Loparco said it would be “inappropriate” for either the SIU or Bordeleau to speak publicly about the matter.

“I would urge Chief Bordeleau to refrain from making further comment about this case while it is ongoing as is his duty under the Police Services Act.”

The Ottawa Police Service has not publicly commented on the pair of assault charges laid by the SIU against patrol Constables Erin Cavan and Jordan Blonde.

The charges follow a May 1 incident at the Queensway Carleton Hospital involving a man known to police and who was in police custody at the time.

Ismael Awaleh, 32, was later charged with possession of crack cocaine, resisting arrest, assault and breaching probation. Police allege Awaleh assaulted Cavan and Blonde while they attempted to arrest him on May 1. It’s believed that Cavan and Blonde were assisting hospital staff when they are alleged to have assaulted Awaleh.

Bordeleau told the Citizen in an email Wednesday night that the force was in the process of “trying to understand the basis and justification for the charges.”

Bordeleau said that though he had spoken to Loparco on Wednesday he was “still seeking information and an explanation.”

The Citizen asked Bordeleau for further comment Thursday after receiving Loparco’s response.

In an email sent to the Citizen, in which Loparco was copied, Bordeleau said: “I fully respect the role and mandate of the SIU, and as chief of police, I understand the responsibility I have not to comment specifically on its investigations.”

He did not reply to questions asking whether he was defending the actions of Cavan and Blonde or whether the force believes the SIU improperly laid criminal charges against the officers.

Ottawa Police Association president Matt Skof said Wednesday the latest charges follow a trend of Ottawa police officers’ being criminally charged for actions they are sworn to do in the course of their duties. The association, and others in the province, have requested oversight into the SIU’s conduct and decisions to lay criminal charges.

This is the first set of charges laid against Ottawa officers since Loparco took the helm of the SIU in October 2013. All three sets of charges against four Ottawa police officers laid by former director Ian Scott resulted in acquittals — including the high-profile sexual assault case of Sgt. Steven Desjourdy and the assault trial of Constables Colin Bowie and Thanh Tran.

Cavan and Blonde are scheduled to appear in court on Dec. 16.
