A former Ottawa jail guard who was accused of assaulting an inmate after a high-profile incident that drew attention from Ontario’s ombudsman has been acquitted.

On Wednesday, the Crown halted prosecution of John Barbro, a former guard at the Innes Road jail, saying that other guards had changed their stories during the course of the case.

Barbro had been charged with assault causing bodily harm after Jean Paul Rheaume was badly hurt in 2010.

Rheaume had been serving 30 days for break and enter at the what is officially known as the Ottawa-Carleton Dentention Centre.

Of the 30 guards on the range at the time of the incident, Barbro was the only one charged.

However, in what was widely described as a “boot-stomping” of Rheaume as he lay face-down, cuffed and shackled, the court heard that Barbro was wearing sneakers, not boots.

Last year, Ontario ombudsman André Marin stood before reporters in front of a photo of a beaten Rheaume and warned of a culture of “brazen acts of violence” infecting Ontario prisons.
