Accused terrorist Ashton Larmond will have to wait until early June before a court rules on what his lawyer calls the “appalling conditions” of the 24-year-old’s incarceration at the Ottawa Carleton Detention Centre.
Larmond’s lawyer, Joseph Addelman, says the much-criticized detention centre is treating Larmond “contrary (to) basic notions of human rights and human dignity.”
Larmond and his twin brother Carlos were arrested in January and face four terrorism-related charges.
According affidavits filed by both Addelman and Larmond, the accused man is being kept in solitary confinement for almost 24 hours a day, forced to wear leg and arm restraints, and strip searched when he does leave his cell.
Larmond also says he is being denied access to documents vital to building his defence and has not been allowed to see a jail psychiatrist or use an exercise yard.
Brother Carlos is apparently being housed in the general prison population. There is a court order forbidding the two from communicating.
Ashton says in his affidavit that he is not aware of any behavioural reason for his strict confinement.
“I have been kept in solitary confinement with no explanation given to me by correctional staff as to why, and no indication that this will ever end,” he wrote.
Addelman is asking the court to order an immediate end to Ashton’s harsh treatment and allow him access to “disclosure documents that is the right of any accused inmate.”
Because of scheduling issues, the complaint won’t be heard until June 5.
