Ottawa – The Ontario Legislature passed Bill 45 – theMaking Healthier Choices Acttoday. The Act will become law later this year. This new legislation will help Ottawa residents make healthier food choices through menu labelling and protect residents from the harmful effects of tobacco use and e-cigarettes.
The Making Healthier Choices Act willenhance the health of Ontarians by enacting the Healthy Menu Choices Act, 2014, the Electronic Cigarettes Act, 2014 and by amending the Smoke-Free Ontario Act.
“This comprehensive legislative package will go a long way in helping Ottawa residents live healthier lives,” said Councillor Shad Qadri, Chair of the Ottawa Board of Health. “The City of Ottawa has been a leader in tobacco control and now Ontario has the most progressive tobacco laws in Canada. The new restrictions on flavoured tobacco and e-cigarette sales will help ensure that the progress to date to de-normalize smoking will continue.”
Ottawa Public Health’s youth-led Freeze the Industry campaign has been raising awareness about the tobacco industry’s use of flavoured tobacco products, including menthol-flavoured products as a way to entice youth, for the past several years. Ottawa continues to see local smoking rates declining with the latest data from 2014 showing an additional two per cent drop. Ottawa’s smoking rate is currently nine per cent.
“The Making Healthier Choices Act is a progressive step to protect people from the harms of tobacco use, and to better inform the public about what they are eating at restaurants, convenience stores and other food premises,” said Dr. Isra Levy, Medical Officer of Health. “The posting of calories for food and beverage items on menus will empower Ottawa residents to make healthier food choices and raise their awareness of the calories they take in relative to the calories they need.”

The Making Healthier Choices Actwill be enacted once it receives Royal Assent, which is expected later this year. Once the new regulations come into effect, Ottawa Public Health will work closely with local retailers and partners to ensure the effective implementation of these new provincial regulations.

Amendments to the Smoke-Free Ontario Act
- Ban the sale of flavoured tobacco products, with delayed implementation date for menthol-flavoured tobacco products.
- Increase maximum fines for those who sell tobacco to youth, making Ontario's maximum fines the highest in Canada.
- Strengthen enforcement to allow for testing of substances used in water pipes (e.g. hookahs, shisha) in indoor public places.
The Electronic Cigarettes Act, 2014
- Ban the sale and supply of e-cigarettes to anyone under the age of 19.
- Prohibit the use of e-cigarettes in certain places where the smoking of tobacco is prohibited.
- Ban the sale of e-cigarettes in certain places where the sale of tobacco is prohibited.
- Prohibit the display and promotion of e-cigarettes in places where e-cigarettes or tobacco products are sold or offered for sale.
The Healthy Menu Choices Act, 2014
- Require food-service owners and operators to post the number of calories in each standard food and beverage on menus and menu boards in regulated food premises, including restaurants, grocery stores and other regulated food-service premises with 20 or more locations in Ontario.
- Authorize public health inspectors to enforce menu labeling requirements.
