New lawsuit filed after OC Transpo bus-train crash

Another passenger who survived the collision between an OC Transpo bus and a passenger train has filed a lawsuit against the city and the estate of the driver.

Imran Mizra and his wife are seeking $1.475 million in damages after alleging in a statement of claim filed Wednesday that he was knocked unconscious and suffered broken bones and other injuries in the September 2013 collision between the double decker bus and the VIA Rail train near the Fallowfield Transitway station that killed five passengers and the driver.

It is the 15th known lawsuit filed against the city.

In the lawsuit, Mizra alleges negligence on the part of the driver David Woodard and the city. None of the allegations have been proven in court, and the city of Ottawa has yet to file a statement of defence.

According to his statement of claim, Mizra, who is a self-employed information technology consultant, said he has lost business as a result of injuries he suffered in the crash.

Mizra alleges that he had been unable to meet with clients or attend trade shows for a year after the crash as a result of his mobility issues from injuries that included a concussion, broken finger, broken lower leg bone and tears to ligaments in his left knee.
