City settles lawsuits from the 2013 bus-train crash

Another family of one of the victims of the 2013 collision between an OC Transpo bus and a Via Rail train has settled a lawsuit against the city.

“We just wanted to get it over with, rather than drag it out through the courts,” Michael More, the father of Rob More, said Monday.

Rob More, 35, was killed when the double-decker bus in which he was riding collided with a Via Rail train in Barrhaven. The More family subsequently sued the City of Ottawa and the estate of the bus driver, Dave Woodward. The More’s statement of claim filed in March 2014 had sought $600,000 in damages.

Michael More declined to specify the settlement, citing a confidentially agreement, but said he hoped the report would be the “final chapter” in the tragedy. “It’s not like we’re going to forget what happened, but we need to get on with our lives.”

The city has settled six of three dozen that have been filed in connection with the crash, CBC News reported, saying that the city has so far paid out nearly $2 million. Total claims of all the lawsuits reportedly amounts to about $26 million.

According to CBC, the family of Michael Bleakney, 57, another victim, has also settled its lawsuit. Their initial statement of claim, filed in January 2014, sought damages of $1.8 million.

The CBC quoted the family’s lawyer, Howard Yegendorf as saying: “There was nothing wrong with the train, there was nothing wrong with the (train) crossing, and there was no medical event for the driver. That leaves one irresistible inference and that was driver error.”
