Hydro Ottawa fined $225,000 for 2012 Moodie Drive fatality

Hydro Ottawa has been fined $225,000 for its role in a deadly job site accident on Moodie Drive four years ago that killed one man and injured two others.

Worker Barry Robertson, 31, was shocked on March 22, 2012 when his boom truck contacted overhead high voltage wires while he and other workers were installing new hydro poles along Moodie Drive near Fallowfield Road.

Hydro Ottawa was found guilty in provincial court on Tuesday of three charges under the Construction Projects Regulations:

• Failing to ensure the boom didn’t come within three metres of energized overhead wires

• Failing to post a signaller to warn the operator when the boom came close to the wires

• Failing to take reasonable precautions to safeguard workers from energized electrical equipment

Two other workers also received shocks in the mishap, but were able to pull Robertson to safety and begin CPR. Robertson, who suffered severe burns, died of his injuries in hospital four days later. Robertson had a child and step-child with his common-law partner.

The men were employed by Dig Safe, a company subcontracted by Greely Construction, which was doing the work for Hydro Ottawa. In 2013, Dig Safe was fined $125,000 for its role in the accident.

The Hydro Ottawa fine, imposed by Justice of the Peace Brian Mackey, comes in addition to a 25 per cent victim fine surcharge.
