A trial date has been set for 2019 for an Arnprior family suing Calabogie Peaks Resort, claiming that unsafe conditions on a tubing hill were to blame for a crash that left a mother of three partly paralyzed.

According to documents filed last March, Kessie Hamilton, 46, visited the ski resort in Calabogie the evening of Mar. 14, 2014 with her three children and another infant.

The statement of claim said that Hamilton and her youngest child, four at the time, went down the tubing hill together around 7 p.m. when their tube slid sideways, colliding with a steel pole at the bottom of the hill.

Hamilton was transported to the Renfrew Hospital, then to the Ottawa Civic Hospital intensive care unit, where she remained for about six weeks.

According to the statement of claim, she stayed for 15 weeks in the rehab centre of the hospital with brain injuries that left her paralyzed on her left side.

The statement said that, after the incident, Hamilton used a wheelchair for mobility, and suffers from fatigue, speech impairment, and difficulties with activities such as grasping, holding and raising her voice. The statement also said she is no longer able to work around the house or at her former job as production management at GE Hitachi.

Her husband Kevin, 55, claimed in the statement he suffered severe emotional trauma and shock from the incident.

The family claimed in the documents that unsafe conditions on the tubing hill led to Kessie’s injuries, but Calabogie Peaks has denied responsibility.

The statement of defence said a waiver is printed on Calabogie Peaks’ lift tickets and liability signs are posted throughout the grounds.

In the documents, the resort also said that Hamilton didn’t follow the rules of the park, knew or should have known the risks, and wasn’t wearing a helmet.

The family is suing the resort for more than $25 million in damages, including expenses, loss of income, and pain and suffering.

Postmedia contacted Kevin Hamilton by phone on Wednesday, but he said he wasn’t able to comment. The family’s lawyer was also unavailable.
