A personal support worker who struck elderly long-term care resident Georges Karam repeatedly in the face has been sentenced to 90 days in jail, a sentence he can serve two days a week between work shifts.
“Mr. Karam is one of our most vulnerable members of our community,” said Justice Julie Bourgeois. “He was not in a position to defend himself and not even to express denunciation of the situation. Vulnerable individuals must be protected.”
The incident at Ottawa’s city-run Garry J. Armstrong long-term care residence in March was captured on video cameras installed by Karam’s family and made headlines around the world.
Bourgeois sentenced Jie Xiao Friday morning, saying the seriousness of the case demands a jail sentence, but that she didn’t want to punish Xiao’s wife and young children as well — for whom he is the sole financial support.
Karam’s grandson, Daniel Nassrallah, who first saw the assault on video surveillance and contacted the police, called the intermittent sentence “disgusting.”
“I am absolutely shocked and appalled,” he said. “It is a failure of our criminal system to allow an individual who essentially assaulted and tortured an elderly vulnerable individual who suffers from dementia to not only receive an intermittent jail sentence, but to schedule the time that he will be in jail based on his convenience and work schedule.”
