Lawyer in Gee-Gees sex assault trial suspended for malpractice

An Ottawa criminal lawyer representing one of the accused in the University of Ottawa sex assault trial in Thunder Bay has been suspended for three months.

After an investigation, the Law Society of Ontario’s tribunal found Christian Jacques Deslauriers guilty of professional misconduct for incidents between June 2010 and Sept. 2011, where Deslauriers allowed a law student to run his legal aid practice.

According to a ruling from Feb. 23, Deslauriers contravened the law society’s rules of professional conduct given the woman was not authorized to represent clients.

“Commencing in September 2011, the respondent failed to satisfy himself that the student-at-law, once her articles of clerkship were completed, was properly licensed and, as such, failed to prevent the unauthorized practice of law,” said the ruling.

Deslauriers has been ordered to pay the law society $12,500 within 18 months from the end of his suspension. Failing that, he will be charged three per cent per year for the unpaid portion.

Guillaume Donovan, who is represented by Deslauriers, and David Foucher, are charged with sexual assault in connection with an alleged incident on Feb. 2, 2014 at a hotel in Thunder Bay. The uOttawa Gee-Gees hockey team was there for a series of games against the Lakehead University Thunderwolves.

Closing submissions were held for the trial on Feb. 16 at the Thunder Bay courthouse.

The alleged victim, who can’t be identified due to a publication ban, testified she had engaged in consensual intercourse with another Gee-Gees player, Taylor Collins, after the two left a bar together.

The woman said that afterward, all of a sudden Collins was gone and two other men then allegedly sexually assaulted her.

During his closing submission, Deslauriers said his client has paid a high price for engaging in a consensual threesome and that his name will be tarnished forever because of the charge against him.

Deslauriers said Donovan showed a lack of respect toward women and his morality has been questioned, but his actions were not illegal.

The judge in the Thunder Bay case is expected to deliver his decision in June.
