There were two men involved in the feud that claimed Christina Voelzing’s life in 2016.
Behnam Yaali has pleaded guilty to manslaughter and is awaiting sentencing. But the man Yaali’s defence argues was the intended victim of the shooting, was also charged in connection to the shooting.
At the time of her death, Voelzing was dating Hassan Khalid, now 32.
Yaali’s defence lawyer, Neil Weinstein, argued Monday at his client’s sentencing hearing that it was Khalid who was the instigator and aggressor in the events that culminated with Voelzing’s death — repeatedly urging Yaali to come confront him and making crude sexual remarks about Voelzing. Yaali fired his gun seven times into the doorway of Voelzing’s Bells Corners home after seeing Khalid armed with a Colt 45.
Khalid, who is also known as “Miller,” was charged with six firearms offences on the day of the shooting, including possessing a loaded restricted firearm without a licence, possessing a gun obtained through crime and possessing a dangerous weapon.
That weapon was found by police to have been the same weapon used in an unrelated shooting 10 days earlier, Weinstein said, where shots were fired in a parking lot. No one was injured in that shooting.
Yaali’s sentencing hearing heard text messages from Voelzing’s roomate to the man who killed her, urging him to not believe any texts being sent from Christina’s phone were coming from her.
“Listen, Miller is forcing her to say that,” read one. “He’s psycho.”
Khalid had previously been convicted of firearms offences in 2008 and 2010.
He’s not scheduled to appear in court again until September.
