Senior Ottawa police officer cleared of sexual assault allegation

A senior Ottawa police officer who was alleged to have sexually assaulted his former spouse has been cleared of any criminal wrongdoing.

In a report to the police board that is set to be received Monday, the police force acknowledges that the civilian watchdog cleared the officer of any criminal wrongdoing and decided not to lay any charges in January of this year.

This newspaper first reported on the Special Investigations Unit’s probe of the allegations in March 2017. The actual allegations date back to 2011.

Because the allegation was made by a spouse, this newspaper is not naming the involved senior officer.

The SIU was notified of the allegation in January 2017 and invoked its mandate. The arms-length civilian agency that investigates any incidents of serious injury, death or allegations of sexual assault involving police had, at the time, designated one subject officer and four witness officers.

The force, in the report to the board, said it was notified of the allegation by the SIU at the end of February 2017.

“No information was provided in relation to the allegations,” the report says.

The force also says that the SIU identified and designated one subject officer and only two witness officers.

“The OPS subsequently requested further information from the SIU, however no further information was provided. During the investigation the professional standards section assisted with the scheduling of interviews and provision of documents, but no further information in relation to the circumstances of the incident or the allegations were made available to the OPS.”

The Ottawa police professional standards section also conducted a review of the file, once the SIU’s probe was completed, to see if there were issues with the conduct of the officers, the force or its policies. That internal review found no issues with the service or its policies, but did find that there were misconduct allegations, which are now being investigated as a result of a Chief’s complaint.

Bordeleau, at the time the senior officer was being investigated by the SIU, came under fire for not suspending the officer while the investigation was ongoing. He defended his decision saying he can only suspend based on facts provided to him by the SIU. The report to the board makes clear that limited information was provided to the force by the watchdog.

A separate report on the work of misconduct investigators at the service, also set to be received by the board Monday, says nine officers were suspended in 2017, the same year that the sexual allegation was made to the SIU.
