Ottawa Senators assistant GM Randy Lee has been charged with a new count of harassment stemming from his May 31 arrest in Buffalo after a hotel shuttle driver complained of unwanted sexual advances.

The new charge — harassment in the second degree — was filed in Buffalo city court on Monday and Lee, 56, is scheduled to be arraigned on the fresh charge July 6. Lee’s previous charge was also harassment in the second degree.

The additional charge — a violation and not a crime — involves the same complainant, a 19-year-old male hotel shuttle driver.

The new count of harassment has been filed under a different legal theory, the district attorney’s office told this newspaper. It was not able to provide additional details early Wednesday morning.

Lee, a longtime Sens executive who is also the GM for its AHL club, has pleaded not guilty to the original count, and his lawyer Paul Cambria says he’ll fight it hard and that the whole case is a misunderstanding.

Lee, who remains suspended until the outcome of his legal troubles, has told this newspaper that he would love to tell his side of the story but has been instructed against it.

According to the Buffalo Police Department report after his May 31 arrest, Lee asked to sit in the front passenger seat of his shuttle van on the way back to The Westin from 716, a sports bar.

It was around 10:30 p.m. on May 30 and Lee was in Buffalo for the scouting combine.

The teen driver had already told Lee to stop touching his shoulder when he started rubbing it, according to the driver’s sworn statement to police.

Then Lee offered to massage parts of his body and then “tried to get (the teen driver) to look at his groin area because he had an erection,” according to the police report.

Police investigated the next day and Lee was handcuffed and spent a night in a jail cell before being arraigned in court on June 1.

That same day, the young driver obtained a temporary protection order that prohibits Lee from communicating with the complainant. Lee must also stay clear of the hotel where he works.

The harassment charges, both violations in New York, have not been proven in court.

The reason Lee spent a night in jail awaiting his June 1 court appearance was because he is a Canadian citizen, according to the district attorney’s office.

Lee is back in Buffalo court on July 6 to be arraigned on the new count.

It was Senators owner Eugene Melnyk who called in celebrity lawyer Paul Cambria to defend his loyal Sens man.

Cambria has represented everyone from NHL star Patrick Kane to shock rocker Marilyn Manson to Hustler publisher Larry Flynt.

In an interview earlier this month, Cambria heaped praise on Melnyk.

“It was a pleasure to talk to (Melnyk). He was solid, professional and determined. He is loyal to his people and he has good reason to be loyal in this situation and with Randy.”

Messages to Cambria in light of the new charge had not yet been returned as of Wednesday morning.

Lee has been released on his own recognizance on the promise that he shows up for his next court appearance in Buffalo.

The district attorney is not asking for jail time (maximum of 15 days), but is seeking a fine (maximum of $250).

District attorney John Flynn told reporters earlier this month that he “will get (the young man) justice” and that Lee will have to answer for his “uncool behaviour.” The district attorney said a night in jail was a “wake-up call” for Lee.
