This was what happened to me. In June, during my one-year anniversary inspection, I discovered that my basement ceiling was covered with molds. Although dormant, molds can become active whenever the temperature and humidity are right. I've pointed this out to the builder, but they refused to clean it up.
So I wrote a letter to the Ontario New Home Warranty people, and CCed the builder. Guess what, a week later, the builder sent in one of their own inspectors to look at the problem. He then concluded that they were not molds, but "stains of molds", but had agreed to clean up.
I kept calling for updates on this problem and ask to schedule a workday over and over in the past 5 months. Finally last week, the workers came and spent two full days cleaning up the molds. The builder even called my furnace company to come and replace the heating pipes that were sprayed with Javex during the cleanup, at the builder's cost of course.
Lesson learned: DO NOT give up, keep fighting for what is lawfully yours!
