I received an N1 for rent increase. It had a full 90 days and everything was properly filled out except my landlord rounded up a cent.
I’m only looking for what is legally allowed. Not interested in hearing judgements.
I know it’s petty to try and fight it but they’ve been awful to me and our relationship is already bad.
My currently rent is $2,022.73 and 2.5% of that is $50.56825. Bjt they raised it by $50.57.
Technically that makes it over the maximum amount allowed.
In this scenario legally do I:
1. pay the corrected amount of 50.56
2. Pay their amount of 50.57
3. Continue paying my old rent without any increase and wait for a new notice with the correct amount?
Again, not interested in hearing how it’s petty. I know it is. I’m just asking for legally what I am able to do.

Rounding up beyond the maximum technically makes the notice invalid. That means that you have the options you outlined, plus considering a compromise with the LL, which is entirely optional. That could be something like offering to pay the legal amount on the effective date or some other middle ground.

我涨房租的量都是低于最大允许量。
房客也懂事,知恩图报,不找麻烦。
