和房东有争议,想取消租房和议,会有法律后果吗?

请教各位大侠
因为看房子时房东说的价钱和后来他写在租约上的不一样,我们不想租这个房子。
但是我们交了200元押金作为下个月搬入他的房子,并且签了一份申请表。如果我们不搬入,会有啥法律后果吗?纳200元是肯定要不回来的。
 
只要LEASE不签就没事,申请表签字没关系。
另外,在申请时房东是不应该收押金的,这是非法的,只有在签了LEASE之后才可以收DEPOSIT。

但是我打电话给Ontario rental housing tribunal ,他们没有说交定金是不对的,听他们的意思,房东有权利采取行动。不明所以。
 
你到底有没有签LEASE?签LEASE之前就收押金是不合法的。收个20来块钱做CREDIT CHECK还说的过去。

Not really, for residencial, the laws are in favor to the tanent.
for commercial, the laws are in favor to the landlord.
Ontario rental housing tribunal is generally fair from my experience.

I dont sign the lease.
When I signed the application form, i gave her $200 as deposit to move in next month.The application form was gave back to the landlord. At that time , the price is empty.
After one day , i went back to sign the lease , the price was different. then i asked for the application form, the price was he wrote in the lease.

Then I said i would not sign the lease .

I have the same feeling that ORHT is on the landlord side.
 
So, the lease was not signed due to the fact that the agreed price was not the one in the lease. You were cheated by the landlord or the person who you discuss the price with. I believe you do have the right to get your money back. The question is: can you proof that you had a different price agreement? If you cann't give proof, it is hard for the the ORHT to make rulings in favor of you.
You know, landlords knows rules much better than the tenents and if they want to trap you, it is not that difficult. But one thing keep in mind, you should never give deposit before the lease is signed. Even if you do, obtain a written receipt saying how much you have deposited for the reason of what and it is the deposit for the "renting of *** unit for the price of *** starting ***". That way, it is safer and you have the proof. Always get a receipt when you pay $$$.
I think it is going to be hard to get the money back. But try anyway, did you try talk to them?

Another question is : If I don't move, what will the landlord do ?

I asked OHRT, the lady said it is possible that the landlord will take legal action because I changed mind and did not moving.
 
It is impossible to win for the landlord in court as long as you didn't sign the lease.

It is possible to win your money back through court because landlord changed price, but it will cost you lots of time and energe.

There is a good/bad idea. You can set a simple trap for the landlord. You will get your money back throght it.
 
一家言 is right. The landlord can do nothing to you as long as the lease was not signed. You just applied for it doesn't necessarily mean that you have to take it.
