Did they promise you that it will be the 1st grade Birch?

They should have showed you the wood before they installed it for you, if it is Different, then they could not argue.

I remembered our agent said if the house is not the same one they showed us before, we could make them fix it.

刚收到我们LAWYER的电话,说BUILDER的LAWYER已经发传真说交易终止,并且退回定金,但传真上BUILDER并未签字。但是,builder 后来又来电说他又改主意了,说传真发错了,还强迫我们CLOSING,否则不退定金,还扬言要上法院告我们。

最后结果总是定不下来,请问这种情况如何处理?
Lawyer说话一言九鼎,而且有传真为证,如果他们自己的律师说出去的决定他们都不遵守的话,他们还告什么啊, 光他自己的律师就跟他没完.

BTW,Halifax房子长的利害吗?盖新房子等多久?:)

不用跟Builder罗索,只跟你自已的Lawer打交道。Builder如果找你,让他跟你的Lawer讲话。
 
先冷静一下,泼点冷水。。。

查一下你的‘agreement of purchase and sale',一般vendor都会声明在closing date之前,purchaser是无权进入property的。。。

房子盖到现在这个程度(地板都铺了),平时没人干活时肯定是会上锁的,所以说,你取得这些地板的照片方式应该是不能理直气壮的。。。弄僵了,builder反咬你一口的可能性是很大的。。。

切记,不要把这些照片当作合法的证据。。。

瞎出主意阿,你可以在pre-move-inspection时就请professional的inspector(我爱我家有inspector的介绍),并在现在把照片私下给inspector看,inspector肯定会找到不能close的合理理由,到时让builder时补偿或返工。。

Action: Flooring not meeting the acceptable condition shall be replaced.
Remarks: Knots and colour variation are natural characteristics of wood and are acceptable within the specified grade. The homeowner’s area rugs, latex-backed material or any coverings over floors may result in colour variation of the floor. Natural lighting will also cause discolouration.

Condition: FLOOR FINISH ON WOOD FLOORING IS NOT UNIFORM
Acceptable Performance/Condition: Floor finish shall provide a visible uniform surface when viewed without magnification from a normal viewing position.
Warranty: One-Year ? Work and Materials • Damage resulting from normal wear and tear is excluded from the statutory warranty.
Action: Hardwood flooring surfaces not uniform in appearance shall be repaired.
Remarks: Wood is a natural product and variation in colour and grain pattern from one piece of flooring to another is normal. The open grain in some wood surfaces tends to show a rough appearance, however this is a natural property of wood and is acceptable. Reflected light, particularly from large windows, magnifies any irregularity in the floors and should not determine acceptance. This applies to both pre-finished and site-applied wood flooring.

only deal with ur own lawyer and u pay for the service, anything happen betweent the deal, your lawyer fully responsible, dont worry, every lawyer has insurance, if anything goes wrong, insurance will pay for it.

you can simple refuse to close, because there is a huge different between the display wood and installed wood. that is 100% misleading the consumers before you signed the purchase agreement.even go to the court, u won't lose.
also you can hire a inspector before u close the deal, there is always can find a safety issue for the house.

谁买房子直接根包工队打交道的?---那不成了自己找人来给自己盖房子了吗,builder这个包工头是干什么的?挣什么钱的?
地板的供货商和安装工人,实际上是builder这个包工头的sub-contractors,他们活干的合格不合格,builder的site manager首先要验收,不合格打回去反工,根本不应该等客户提了意见,在那里加码要价才给返工.:o
pre-move in Inspection律师管什么?验收不合格就不去律师那里close deal.:smokin:
2000-3000够几个月房租的?凭什么要压价?压了价就可以享受这个花地板了?那人家花钱升级地板干什么?
如果现在住的房子问题不迫在眉睫,就跟他们死磕, 让builder:1,想办法如期交房(地板换掉),要么2,出你们房租,等到装好再交房,要么3,你们入住以后返工,免费再升级一档:smokin:
折衷的办法是,你们给builder宽限一个月交房日期,让他们把装修的活干仔细利索了再交.:D 个人观点.

其实买房的时候找个律师很重要.进行过程中,尽量与你的律师配合.出了问题最好找律师,就是有十足的把握,也要找律师.

It is such a pity...you surrender too fast...you should 死磕 with the builder...it is your right!

I guess your lawyer and maybe your agent as well, would be happy...No matter whether the deal close or not, you have to pay them some money...
 
If your lawyer is not helpful at all during this issue, you do not feel that your lawyer is on your side, did not help you to get all the rights that you deserve, you can turn to sue your lawyer.
