My wife retured China in July and she already lived in Canada more than three years. The question i am asking is that according to the new Immigration Law, can she stay in China more than six months? Please if you know the answer, let me know. Thanks you so much. It is urgent.
 
Permanent residents

Persons who have been admitted to Canada as permanent residents have the right to come to the country and remain here, provided they have not lost that status or it has not been established that they have engaged in activities, such as criminal acts, that would otherwise subject them to removal.

Conditions may be imposed for a certain period on some permanent residents, such as entrepreneurs. A permanent resident must live in Canada for at least 730 days (two years) within a five-year period. In some situations, time spent outside Canada may count. All permanent residents must comply with this residency requirement or risk losing their status.

Like Canadian citizens, permanent residents also enjoy all the rights guaranteed under the Canadian Charter of Rights and Freedoms, such as equality rights, legal rights, mobility rights, freedom of religion, freedom of expression and freedom of association.

i just want to clarify that both of us are permanent residents and in the last five year, we have lived in canada more than three year. If i correctly understood what you said, my wife under the New Law, she can stay in China for at least one year.

if i misunderstood anything, please let me know.

my understanding:

When your wife come back to Canada, they count back five years and see if she have been in Canada for at least 2 years. So, if she were in Canada in the past two years, then she can stay in China for 3 years.

Right?
 
Hi, guys, my 2 cents:

1. Yes. Both of you have reached the right result but not applied in this case. It only applied to the situation that your wife has got her Maple Card, when your Immigration paper is not a valid document for your wife travel abroad.
2. Her Immigration Paper is still valid before Dec 31, 2003. She has to be back before that day. After that deadline, she has to get her Maple Card to be abroad.
3. The 5-year period is meaningless unless you would like to renew your Maple Card.
