我在国内的朋友请我帮忙找一点资料：

起因是这样的， Dell公司的一个销售员在写信给美国客户的时候说：你买一台联想的电脑，就等于是资助了中国政府……
这事在国内媒体界引起轩然大波，我在国内做编辑的朋友想就此事写一篇专题评论，但需要国外，尤其是北美这边的看法，我不知道哪里可以找到这方面的东东，请地头熟的，英语好的XDJM帮忙，谢谢了先

对于这件事情北美的媒体一致地保持了沉默,让人对时间的真实性产生怀疑,当然也可能是因为媒体不愿意就这样不光彩的事情发表评论

一个人不能代表一个公司，况且只是个销售人员。比如说我说我讨厌布什，十个人恐怕有九个同意，但我如果说同讨厌美国人，大部分人恐怕都不同意（CFC例外）。国内媒体实在是没事找事闲的慌。从商业策略上讲更可笑：戴尔用得着这样吗？IBM在PC机方面早就被戴尔全面打败了。不能不让人怀疑鼓吹此事之人的目的。

国内媒体热抄这个事件是有他们自己的目的或者原因,不能抹杀的事实就是DELL的销售人员确实是在工作当中发表了这样的言论,不能代表公司一说是公司避免麻烦的一贯作法,没有见过那个公司出了这样的事情会承认说出问题的员工是代表公司的,除非管PR的VP脑子进水了

However from a legal point of view, publicizing DELL's private emails without DELL's prior consent, wouldn't that be a violation of some law? I seriously don't know the answer to this, but all the outgoing emails from our company remain properties of the company.

这样的事情从legal的角度来看是没有问题的,只能说DELL销售的方法有ethical的问题.

除非那个email的recipient和DELL签也有保密协议,否则没有什么法律上的东西约束他不能公开这个email, 除非DELL的email能做到像网站注册那样,接受者确认他接受DELL的条件才能打开email. 否则就算DELL的email server在每封email加上说明说这个message是DELL财产,别人要公开要DELL同意的footnote也没有用.

当然有法律以外的东西如公司本身的规定等等来约束接受一方的行为.
就算签了保密协议,也得上法庭去裁决违反的一方到底应该收到何种制裁.

从legal的角度来看，不象PT说的那么非黑即白，我认为Dell got a case。但是，Dell忙于damage control，根本不会去打这类官司，即便打赢了，对公司也没有任何好处。

ALL our outgoing emails have such "disclaimer", for the lack of better word, automatically attached to each outgoing message.
