一般需要由父母中收入较低的那个claim child care expenses.
child care expense大致上包括:baby sitting ,day nursery services, day camps, boarding school and camps.
Deduction limitation:$7,000 per child (under 7 years old),4000 per child(over 7 below 17 years old)但总体数目不可以超过申报人年收入的2/3,这两者哪个低取哪个
EXAMPLE:3个小孩,1个4岁,1个6岁,1个12岁。 假设申报人为母亲,年收入$40,000
那么就应该取以下两者中较低的那个
1. 2*7000+1*4000=18,000
2. 2/3 * 40,000= 26,667
那就最多可以申报 $18,000.希望可以帮到你

I checked the guide.
It seems that you cannot claim your child as a dependent for the credit, unless you and your spouse seperated or 离婚.
