在国内向大家问候情人节快乐
今天想向大家讨教 一下，我应该怎么办
我是于2001年10月18日登陆的，当时还在国内工作，所以第一年内只去了三四次，每次一个月。
2003年辞职后，我在加拿大呆了一年多
2004年6月回国到现在还没时间回去
从登陆时间开始算的话，我现在一共在加拿大住了一年半多一点。
枫叶卡是2003年3月拿到的，到期日是2008年3月。
现在困惑的是，到底这个5年内住满2年的规定， 是从登陆时开始算，还是从拿到枫叶卡开始算。因为如果是前者的话，那么我最迟6月份就得回加拿大呆着，才不至于被取消绿卡。真担心会在温哥华机场，被遣送回国。
而如果是后者，那么拿到卡之前住的时间是否不能算，即使从2003年3月开始算，我也大可到2007年春天才回去。
我不想失去绿卡，但目前我在国内的工作很好，刚刚又升职加薪：）突然辞职不好意思，而且这个媒体的工作我很喜欢（顺便向大家约稿哦，关于你们的休闲生活方式有没有许多想说的呢：））。其实我是想在国内再工作一段时间，以后即使因为要出国而不得不辞职，也不会太遗憾。
这次回去，除了不想让绿卡到期外，还想给孩子办绿卡。孩子是去年夏天我在国内生的，一直没有在国内上户口。不知道这次回去办孩子户口的事，要向什么部门申请，要在国内准备什么资料？
五年内二年的规定，还没改变吧？

摘几句给你看有用不. 看样子是按拿枫叶卡开始算, 因为"examination time"不是指你入关, 而是指你枫叶卡满五年时候去续的时候.

A28(2)(b)(ii): If a permanent

5年住2年当然是从你登陆开始算, 跟你拿不拿枫叶卡没有关系. 否则你一直不申请枫叶卡岂不是可以一直在中国呆着.

不全"当然从登陆算起". 准确地说是从移民官检查你的情况时, 往回算五年.

If you have been a permanent resident for more than five years, the assessment of your residency obligations will be limited to the five years immediately before your examination.

楼主情况应该属于这种.

如果是2002年6月28日或以后登陆的, 每五年就是从登陆开始算起, 因为登陆那天就是发第一张枫叶卡的那天. 如果是2002年6月之前登陆的, 就从拿枫叶卡算起, 因为枫叶卡每五年要续一次, 所以移民官每5年有一次检查你的机会. 楼主的情况应该从拿枫叶卡算起.

但是但是但是!!! 以上所说都是主要针对长期在加拿大境内居住的人. 长期离境的人还多一个危险, 就是入境的时候也是一个检查你情况的时候.

I think it will be based on the maple leaf card

I used to investigate this issue as well for my parents. The conclusion is that it should be based on maple leaf card for the 2 out of 5 years requirement; otherwise it is hard to track the time.

The maple leaf card is valid for 5 years so every 5 years (maple card expiry) is a period to count. Every 5 years is independent.

While, you might call the CIC to confirm through.

For the purposes of this application, a Canadian business is defined as:

a corporation that is incorporated under the laws of Canada or of a province and that has an ongoing operation in Canada; or
an enterprise that has an ongoing operation in Canada and is capable of generating revenue and is carried out in anticipation of profit, and in which a majority of voting or ownership interests is held by Canadian citizens, permanent residents, or Canadian businesses as defined above; or

OPTION 3. Accompanying a permanent resident outside Canada

Humanitarian and Compassionate Grounds
If you are unable to meet the residency obligation, we will consider any compelling humanitarian and compassionate factors in your individual circumstances that may justify the retention of permanent resident status. We will notify you if this additional assessment is required.

如果你还想保留移民身份, 劝你趁早过来, 否则你入境的时候会有麻烦的.你5年住不够2年的话, 移民局有充分的理由不让你入境的, 你最好不要抱侥幸心理. 在申请枫叶卡的时候是要你填从你登陆到申请这段时间你什么时间住在加, 什么时间出境的, 如果你当时都照实填了, 我想移民局会记录在案的.

可是有点迷惑 因为有的说是从登陆，有的说是枫叶卡
要不我试着下月请一个星期假回一趟加拿大，试试在入关时会不会查我的护照
我是抱着侥幸心理，因为现在只有枫叶卡上有五年的时间，而当时登陆时的鉴证纸在换卡时已经收回了，那么如果从登陆算，他们是否会查我换证时的纪录，还是查我的护照。如果我换一本护照呢？
如果在国内先登记孩子的户口，不是太麻烦吗？申请家庭团聚后还能再改成移民身份？单是出生证明不行吗？
当时没有出国生孩子是因为先生太忙，没有时间陪我回加住着，估计在加找人帮忙很难，所以就在国内生了，没想到有这么多的事
我先生也是移民，他在加住了两年半多，可是硕士毕业就回国了，因为他说他不想要什么公民身份，也不在乎下一个五年是否保留移民身份，所以他不太可能再长期回加，但他要求我必须保留身份，主要是为了孩子着想。好晕啊

太好了，我看到这一条，是不是说明，只要我先生已经住满两年，那么我就不必遵循这个五年计划，只要在他下一个五年期限到来前，我去住两年？
我先生在加时间大概有33个月了.
