紧急求教:银行这样做算不算毁约?

2008年2月我与银行签订mortgage合约为5年variable fixed,利率为prime-A%。2009年,我卖掉了这个旧房准备搬进新房,新mortgage 大于旧mortgage, 一切与银行谈妥,新mortgage 利率仍沿用2008年签订的prime-A%,可银行Mortgage Centre突然通知我他们不能给我这么好的利率,我该怎么办,请看2008年合约条款:

K. Portability and Assumption Options
K.1Portability
(6) If your new principal amount is more than the Outstanding Amount, the interest rate for your new varibale rate mortgage will be the same as the Interest Rate.

有人遇到过类似情况吗?怎么处理的?拜谢!
 
1)向银行求情兼施压,看他们有没有诚心牺牲点利益留住你这个老客户(我曾成功过);

2)实在不行找律师看看。

I have a question for the Gantrycrane, is there any closing date gap between your moving out date and moving in date? did the bank have the requirement on this? such as the gap must be less than 1 month or 3 months, thanks!
 
1).check your agreement signed with Bank if you have one, generally it should be good for 90 days, if an agreement is going to be signed, you may ask bank the possibility to extend 90 days to 120 days or even more.
2). Bank usually can provide a bridging loan with a varible rate to bridge the gap, the varible rate is Prime either + or - x%, the x can be negotiable (minus x% is no longer applicable for now). the bridging loan is useful when the closing date for your new home or a home you will move to is not the same date to be taken the possession by a buyer to your current home. it's very hard to get all transition done within one day.
